(E/ECR & S/La Costa Ave.) SP1 2 3 4 5 6 7 8 9 10 11 12 n a- c 0 18 19 20 21 22 23 24 25 26 27 28 , ORDINANCE NO. 9476 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING ORDINANCE NO. 9447 TO REVISE THE CONDITIONS OF APPROVAL FOR SPECIFIC PLAN (SP-171) FOR A SUBDIVISION CONSISTING OF 225 SINGLE FAMILY LOTS AND TWO OPEN SPACE LOTS ON 106 ACRES LOCATED EAST OF EL CAMINO REAL AND SOUTH OF LA COSTA AVENUE. APPLICANT: LA COSTA LAND COMPANY. The City Council of the City of Carlsbad, California, orda'in as follows: SECTION 1: Findings. The approval of the amendments does to Specific Plan (SP-171) set out below is justified by the following findings : 1. The proposed Specific Plan Amendment is consistent with the General Plan because: a. The Land Use Plan Map of the General Plan shows the subject property as Residential Medium-High Density (10-20 dwelling units per acre). The Specific Plan Amendment would provide 2.5 dwelling units per acre. 2. The proposed Specific Plan Amendment is consistent with the adopted Master Plan because: a. A La Costa Master Plan partial amendment was adopte by City Council Ordinance No. 9469 (November 2, 197 to accommodate the subject proposal. 3. The proposed Specific Plan Amendment is consistent with the City of Carlsbad Environmental Protection Ordinance of 1972 because: a. An EIR and supplemental information have been previously submitted and accepted. b. The Planning Director has determined that the Environmental Protection Ordinance has been met by Prior Compliance (Section 19.04.1531. 4. The proposed Specific Plan Amendment conforms to applicable City policies and ordinances dealing with public 1 2 3 4 5 E 7 E 9 1c 11 12 a 1s 2c 21 22 22 24 25 26 27 28 Eacilities because: a. Conditions of previous approvals ensure the above. SECTION 2: Ordinance No. 9447 is amended by the amendment 3f Section 4 - Development Conditions, as follows: 1. Condition 2 is amended to read: (2) All development conditions of the R-1 zone shall apply to all areas encompassed by this specific plan. 2. Condition 3 is hereby deleted. SECTION 3: Administration and Enforcement. The Building Department shall not approve any building for occupancy until the Planning Director has certified that all the conditions of this ordinance have been satisfied. EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least once in the Carlsbad Journal within fifteen days after its adoption INTRODUCED AND FIRST READ at a regular meeting of the Carlsbad City Council held on the 18th day of January , 1977, and thereafter PASSED AND ADOPTED at a regular meeting of said Council held on the 1st day of February , 1977 by the following vote, to wit: AYES : Councilmen Frazee, Lewis, Packard, Skotnicki and NOES : None Councilwoman Casler ABSENT: None ATTEST : A ( SEAL)
