ORDINANCE NO. 7045
AND ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA AMENDING
CHAPTER 13.08 OF THE MUNICIPAL CODE BY
THE AMENDMENT OF SECTIONS 13.08.080 AND
13.08.085 TO INCREASE THE SEWER SYSTEM
CONNECTION FEES.
WHEREAS, the City Council of the City of Carlsbad, Cali-
fornia, finds that the sewer connection fees established for
the City of Carlsbad are inadequate; and
WHEREAS, said Council finds that the connection fees
hereafter set forth are reasonable and are required in the
public interest;
NOW, THEREFORE, the City Council of the City of Carlsbad,
California does ordain as follows:
SECTION 1: Title 13, Chapter 13.08 of the Carlsbad
Municipal Code is amended by the amendment of Section 13.08.080
and Section 13.08.085 to read as follows:
"Section 13.08.080 Sewer Connection Fees. Except as
lerei-nafterprovided, every person who connects one or more
living units to the City sewer system shall pay the City, prior
to the issuance of a sewer connection permit, a connection fee
of five hundred dollars per living unit. All sewer connection
fees shall be placed in the joint sewer construction fund and
shall be used to pay for capital improvements of said system.
For a period of five years from June 30, 1974 the fee for a
living unit or occupied mobile home space in existence and
within the City limits on or before said date shall be fifty
dollars, providing the connection to the sewer system is
completed within said period."

"Section 13.08.085 Sewer Connection Permit.
(a) Any time after issuance of a valid building permit,
upon application and payment of the required fee, a sewer
zonnection permit may be issued by the City Engineer authori-
zing connection of the structure for which the building permit
has been issued to the sewer system.
(b) It shall be unlawful for any person to connect to the
Jity sewer system without first obtaining a valid sewer connection
permit.
(c) Every permit issued pursuant to this section shall
zxpire by limitation and become null and void if work on the
connection authorized by such permit is not commenced within
sixty days from the date of issuance of such permit, or if such
uork is suspended or abandoned at any time after the work is
commenced for a period of 120 days. Before such work can be
recommenced a new permit shall be first obtained and the fee
therefore shall be two hundred fifty dollars, provided that
such suspension or abandonment has not exceeded one year."
EFFECTIVE DATE: This ordinance shall be effective 30 days
after adoption. The City Clerk of the City of Carlsbad shall
certify to the adoption of this ordinance and cause it to be
published once in the Carlsbad Journal within Fifteen days
after its adoption.
