AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 21, OF THE CARLSBAD MUNICIPAL CODE BY THE ADDITION OF CHAPTER 21.29 TO PROVIDE FOR A (C-T) COMMERCIAL-TOURIST ZOPJE (ZCA-83). The City Council of the City of Carlsbad, California, does ordain as follows: "Chapter 21.29 C-T COJU!IERCLAL-TOURIST ZONE Sections : 21.29.010 Intent and purpose. 21.29.020 Application. 21.29.030 Permitted uses and structures. 21.29.040 Accessory uses and structures. 21.29.050 Uses and structures permitted by conditional use permit. 21.29.060 Building height. 21.29.070 Placement of buildings. 21.29.010 Intent and purpose. The intent and purpose of the C-T Commercial-Tourist Zone is to provide for the development and use by certain types of commercial businesses near trans- portation centers, recreation areas or in close proximity to highways and freeways used by interregional traffic. The following regulations are intended to insure that tourist oriented uses will be coordinated with compatible accessory uses, protect surrounding properties, insure safe traffic circulation and promote economically viable tourist oriented areas. 21.29.020 Application. It is intended that the C-T Commercial-Tourist Zone be placed on properties that are accessible -- to interregional traffic or- recreation areas as designated by the General Plan and any applicable specific plans. A C-T Commercial-Tourist Zone district shall have a minimum area of three acres of adjacent properties. A public street may separate adjacent properties provided the properties are directly across the public street from each other. 21.29.030 Permitted uses and structures. In the C-T Commercial-Tourist Zone, only the following uses and structures are permitted subject to the requirements of this Chapter and to the development standards provided in Chapter 21.41 and 21.44: (1) Hotels; (2) Motels; (3) Restaurants. In the C-T Commercial-Tourist Zone the following accessory uses are permitted provided that the accessory use is developed as an intregal part of a permitted use within the same structure or parcel of land. (1) Apparel and accessories; (2) Bakery; (3) Beauty and barber shops; (4) Commercial parking lots; (5) Confectionary store; (6) Dry cleaning, laundry pickup service only; (7) Florists; (8) Health clubs or spas; (9) Novelty and/or souvenir store; (10) Stationery store; (11) Travel Agencies. 21.29.050 Uses and structure permitted by conditional use permit. Subject to the provision of Chapter 21.50, the following uses and structures are permitted by conditional use permit. In order to approve a conditional use permit, it must be found that the use, as proposed, will not adversely affect the viability or use of the area as a commercial-tourist district or adversely affect nearby uses or traffic movements. (1) Automobile service station; (2) Bus passenger terminals ; (3) Produce stores or stands; (4) Recreation facilities, commercial; (5) Restaurants that provide drive-in, drive-thru or take out service. 21-29.060 Building height. No huilding shall exceed a height of thirty-five feet. 21.29.070 Placement of buildings. On any lot where the side or rear lot line abuts property in any "Rss zone and no alley intervenes, no building shall be erected closer than ten feet to such lot line; provided further, if such a lot abuts upon an alley, no building shall be erected closer than five feet to the rear lot line of such lot." EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least once in the Carlsbad Journal within fifteen days after its adopt ion.
