ORDINANCE NO. 9481
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, AMENDING ORDINANCE
NOS. 9279 AND 9456 BY THE AMENDMENT OF THE
SPECIFIC PLAN ADOPTED THEREBY TO PERMIT THE
CONSTRUCTION, SUBJECT TO CERTAIN CONDITIONS,
OF WATER TREATMENT FACILITIES AND A MAIN- TENANCE BUILDING AT THE ENCINA POWER PLANT
ON PROPERTY GENERALLY LOCATED WEST OF INTER-
STATE 5 and SOUTH OF THE AGUA HEDIONDA
LAGOON (SP-144 (C) ) . APPLICANT: SAN DIEGO
GAS & ELECTRIC COMPANY.
The City Council of the City of Carlsbad, California, does
ordain as follows:
SECTION 1: That it does find and declare as follows:
1. A verified application for an amendment to SP-144 to
permit the construction of water treatment facilities and a
maintenance building at the Encina Power Plant has been received
for the following described property:
Those portions of Lots "F" and "H" of Rancho Aqua
Hedionda, Map 823, and Block "W" of Palisades Number
Two, Map 1803, in the City of Carlsbad, County of
San Diego, State of California, shown and delineated on S.B.E. Map 141-37-73-C, Parcels 1 through 10.
2. In accord with Title 21 of the Carlsbad Municipal Code,
the matter was referred to the Planning Commission for public
hearing.
3. A duly noticed public hearing was held before the
Planning Commission at the time and in the place specified in
said notice on March 9, 1977 at which time all interested persons
were heard.
4. The applicant has complied with the Public Facility
Element of the General Plan and has provided the necessary
information which ensures Public Facilities will be available
concurrent with need.

5. The subject application has complied with the require-
ments of the City of Carlsbad "Environmental Protection Ordinance
of 1972" in that the maintenance building is exempt pursuant to
Section 19.04.090 of the Carlsbad Municipal Code and a negative
declaration has been filed for the water treatment facilities.
6. The Planning Commission unanimously recommended the
approval of the applicant's request.
7. That a duly noticed public hearing was held before the
City Council on April 5, 1977.
8. At said public hearing, upon hearing and considering
the testimony and arguments, if any, of all persons who desired
to be heard, the City Council considered all factors relating to
the Specific Plan amendment and determined that the findings of the
Planning Commission contained in Resolution No. 1338 constitute
the findings of the City Council in this matter.
SECTION 2: That Ordinance No. 9279 as amended by
Ordinance No. 9456 is further amended by the amendment of
Section 2 of said ordinances to replace the Specific Plan Map
attached thereto with a revised plan labeled (SP-l44(C), Exhib
dated April 5, 1977, on file in the Planning Department and
incorporated by reference herein, which is hereby adopted.

SECTION 3: That Ordinance No. 9279 is amended by the amend-
ment of Section 2 of said ordinance to add Condition No. 15 to
read as follows:
"15. In addition to the above conditions, the revised
portions of the specific plan which permits the
construction of water treatment facilities and a maintenance building shall be accomplished in accord with the revised specific plan SP-144(C) and the
plot plan marked Exhibit A, dated January 31, 1977,
attached hereto and made a part hereof, and shall

be subject to the following conditions:
A. The water treatment ponds shall be constructed and maintained to the following standards to minimize the likelihood of the ponds serving as
mosquito breeding sources:
1. Confine standing water impoundment to as
small an area as possible.
2. All pond'areas shall be lined with a nonporou:
material acceptable to the City Engineer.
3. Maintain a removal program of dense aquatic
vegetation, such as cattails, bulrush, tule,
pondweed, etc.
4. Maintain a mosquito fish [Gainbusia affinis)
population, as necessary.
5. Maintain routine (weekly) inspections of watei
impoundqents to detect mosquito breeding,

B. Prior to the issuance of building permits for the maintenance building, the applicant shall submit
a plot plan to the Planning Director for review
and approval showing which existing shops and
storage activities are to be removed and
consolidated into the new structure."
EFFECTIVE DATE: This ordinance shall be effective
thirty days after its adoption, and the City Clerk shall
certify to the adoption of this ordinance and cause it to be
published at least once in the Carlsbad Journal within fifteen
days after its adoption.

INTRODUCED AND FIRST READ at a regular meeting of the
Carlsbad City Council held on the 19th day of Apri 1 I
1977, and thereafter
PASSED AND ADOPTED at a regular meeting of said Council
held on the 3rd day of May , 1977, by the following
vote, to wit:
AYES : Councilmen Lewis, Packard, Skotnicki and
NOES : None Councilwoman Casler
ABSENT : None
ABSTAINED: Councilman Fraz
