HomeMy WebLinkAbout1977-08-02; City Council; 9486; Redevelopment study area commercial developments prohibited1 2 3 4 5 6 7 E s ZC 11 1E 2( 21 2: 21 24 2: 2( 2: 2E / ORDINANCE NO. 9486 AN INTERIM ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA ADOPTED AS AN URGENCY MEASURE PROHIBITING CEIiTAIN CONMERCIAL DEVELOPMENTS IN THE DOIJNTOm REDEVELOPMENT STUDY AREA. WHEREAS, the City Council has determined it to be in the public interest to consider various ways of revitalizing that portion Df the City of Carlsbad known as "downtown"; and WHEREAS, the City Council has designated portions of the City, including downtown, as a "Redevelopment Study Area", pursuant to the California Redevelopment Law; and WHEREAS, the City Council has adopted a work program providing for certain planning studieswithinthe study area to consider, among other things, changes in the existing zoning ordinances; and WHEREAS, upon recommendation of the Planning Director the City Council has determined that the public interest requires the temporary prohibition of certain commercial uses within the study area until the planning studies can be complete; and WHEREAS, the City Council has determined that it is necessary, to protect the public health, safety and welfare, to adopt this interim ordinance as an urgency measure to prohibit certain uses, which may detract from the Citygs efforts to revitalize downtown, pending the completion of the planning studies. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Carlsbad, California, as follows: SECTION 1: That the commercial developments listed in this section are prohibited in that portion of the City known as the "Redevelopment Study Area", as hereinafter defined. uses are as follows: The prohibitec Thrift shops? bars as separate uses not in F f I I 1 1 1 zonnection with a bonafide eating establishment; adult entertain- It establishments (including movie houses showing "X0' rated Ties); massage parlors; card rooms, and other similar uses. 3 Redevelopment Study Area is defined as including all properties thin the corporate limits of the City of Carlsbad located in an ea bounded on the north by the northerly city limits, on the st by the mean high tide line of the Pacific Ocean, on the south the southerly edge of the right-of-way line of Cannon Road, and the east by the westerly edge of the right-of-way for Interstate ve . SECTION 2: This interim ordinance is adopted as an urgency 3asure pursuant to California Government Code Section 65858 for le reasons set out in the recitals hereto and shall take effect mediately. SECTION 3: The City Clerk shall certify to the adoption of his ordinance and cause it to be published at least once in the arlsbad Journal within fifteen days after it is adopted.
