ORDINANCE NO. 9497
AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, "DING
ORDINANCE NO. 9495 TO EXEMPT R-2 CONVERSIONS
FROM THE MORATORIUM ON THE PROCESSING OF
SUBDIVISIONS FOR THE CONVERSION OF EXISTING
STRUCTURES TO CONDOMINIUMS.
WHEREAS, the City Council has by the adoption of Ordinance
Yo. 9495 declared a citywide moratorium on the processing of
subdivision maps for the conversion of existing structures to
condominiums; and
WHEREAS, the City Council has determined that pending the
development of a condominium conversion ordinance, the processing
Df conversions on R-2 lots can be allowed to continue subject to
certain conditions without adversely affecting the purposes to
be achieved by the adoption of such ordinance.
NOW, THEREFORE, BE IT ORDALNED by the City Council of the
City of Carlsbad, California, as follows:
SECTION 1: That Section 1 of Ordinance No. 9495 is amended
the addition of the following:
"This ordinance shall also not apply to applications for
for subdivisions to convert duplexes in the R-2 zone to
condominiums provided applicant agrees that the following
conditions shall be fulfilled prior to approval of the
final map:
1. Driveways and uncovered parking stalls shall be paved
with a minimum of two inches of asphalt concrete in
four inches of decomposed ground. Wheel stops shall be
placed two and one-half feet from the end of each
parking stall that abuts walls, buildings, walkways, or
sidewalks.

EFFECTIVE DATE: This ordinance shall be effective thirty
days after its adoption, and the City Clerk shall certify to the
adoption of this ordinance and cause it to be published at least
once in the Carlsbad Journal within fifteen days after its adoption.
INTRODUCED AND FIRST READ at a regular meeting of the
Carlsbad City Council held on the 4th day of Apri 1 , 1978
and thereafter
PASSED AND ADOPTED at a regular meeting of said City Council
held on the 18th day of April , 1978 by the following vote,
to wit:
