ORDINANCE NO. 1223
ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA DECLARING A NEED FOR A
COMMUNITY DEVELOPMENT COMMISSION TO FUNCTION IN THE CITY OF CARLSBAD.
WHEREAS, Part 1.7, Chapter 2, Article 1 of the Health and
Safety Code of the State of California establishes a public body
corporate and politic, known as the Community Development
Commission in order that a community may have the option of
operating and governing its Redevelopment Agency and Housing
Authority under a single operating entity and board, and
WHEREAS, such Commission is created and authorized to
exercise all powers reserved to housing authorities and redevelop-
ment agencies, but provided, pursuant to Section 34115 that such
public body, corporate and politic shall not transact any
business or exercise any powers unless by ordinance the City
Council of the City of Carlsbad declares that there is a need
for such commission to function.
NOW, THEREFORE, the City Council of the City of Carlsbad
California, does ordain as follows:
Section 1: It is hereby found and declared pursuant
to Section 34115 of the Health and Safety Code, that there is a need for a Community Development Commission created and established
by Section 34110 of said Code to function
in the City of Carlsbad, and that there is a need for such Commission to function with
respect to the Carlsbad Redevelopment
Agency and the Carlsbad Housing Authority.
Said Commission is hereby authorized to
transact business and exercise the powers
of said agency and authority. The Commission formed pursuant to this ordinance shall be known as the Carlsbad Housing and Redevelopment Commission.

Pursuant to the provisions of Section
34120 of the Health and Safety Code, the City Council of the City of Carlsbad,
California, hereby declares itself to be
the Commission provided in Section 1
hereof and that all of the rights,
powers, duties, privileges and immunities
vested by Part 1.7 of the Health and
Safety Code in such Commission shall be and are vested in said Council.
The terms and manner of removal and
procedures for appointment or election
of the Commissioners shall be those of
the City Council. The compensation of the
Commissioners shall be established by
resolution of the City Council.
The Commission hereby authorized to
function shall cause a certified copy of this ordinance to be filed in the Office of the Secretary of State of the State of California and with the State Department of Housing and Community Development.
FIRST READ at a regular meeting of the
City of Carlsbad, California, held on
the 16th day Of October , 1979, and thereafter.
PASSED, APPROVED, AND ADOPTED at a regular meeting of
the City Council of the City of Carlsbad held the 6t.h
day of November , 1979, by the following vote, to wit:
AYES : Councilmen Packard, Skotnicki, Anear, Lewis and
NOES : None
