HomeMy WebLinkAbout1979-11-06; City Council; 1224; CMC 2.40 amends - Community Development Committee createdORDINANCE NO. 1 224 1 2 3 4 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, RESCINDING RESOLUTION NO. 5720 AND AMENDING CHAPTER 2.40 OF THE CARLSBAD MUNICIPAL CODE TO CREATE A COMMUNITY DEVELOPMENT COMMITTEE TO REPLACE THE HOUSING COMMISSION AND THE VILLAGE REDEVELOPMENT PROJECT A-A COMMITTEE. WHEREAS, the legislative body of the City of Carlsbad 5 II has by the adoption of Ordinance No. ~773 designated itself 6 I1 a Community Development Commission for the purpose of operating and governing its housing authority and redevelopment agency under one operating entity, and 8 9 10 WHEREAS, the legislative body desires to create a 11 12 community development committee in accordance with Section 34120.5 of the Health and Safety Code for the purpose of advising the Commission on all matters to come before it I3 ll with the exceptions as noted in Section 34120.5(b); 14 ll 15 16 17 18 19 NOW, THEREFORE, the City Council of the City of Carlsbad does ordain as follows: Section 1: That Title 2 of the Carlsbad Municipal Code is amended by the amendment of Chapter 2.40 to read as follows: "Chapter 2.40 C'ARLSBAD HOUSIITG AND REDEVELOPMENT ADVISORY COMMITTEE 2o I/ Sections: 21 22 23 24 25 26 27 2.40.010 Established 2.40.020 Membership 2.40.030 Qualifications 2.40.040 Meetings 2.40.050 Vote Required 2.40.060 Functions 2.40.010 Established. Pursuant to Section 34120.5 of the California lEealth and Safety Code, a community development committee is created as an advisory body to the City Council and Community Development Commission. The Committee shall be known as the Carlsbad Housing and Redevelopment Advisory Committee. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 2-40.020 Membership. The Committee shall consist of nine members. The members shall be appointed by the City Council. The members shall serve two-year terms and each member shall serve until his successor is duly appointed and qualified. The initial members of the Committee shall serve staggered terms as follows: (a) Three members shall serve for a period of one year: (b) Three members shall serve for a period of eighteen months; and (c) Three members shall serve for a period of two years. Members shall serve without compensation. Members of the Committee may be removed by a majority vote of the City Council. 2.40.030 Qualifications, At least two members of the Committee shall be tenants of the housing authority, a, least one of which shall be over sixty-two years of age, If a tenant member ceases to be a tenant of the authority his membership on the Commission shall terminate and another tenant of the authority shall be appointed for the remainder of the unexpired term. Nontenant members of the Committee shall be electors of the City and shall be appointed as follows: (a) Two members of existing organizations located (b) (c) Two business persons from within a redevelop- (d) Two persons trained or experienced in architecture within a Redevelopment Project Area. The Committee shall meet regularly once a month, on the fourth Monday of each month, or more often if necessary, for the transaction of business. In the event a regular meeting falls on a legal holiday, said meeting shall be held on the next succeeding business day, The Committee shall elect a chairman and establish its own rules and procedures necessary for the conduct of its business. 2.40.050 Vote Required. Five meinbers of the Committee shall constitute a quorum. The affirmative vote of not less than five members shall be necessary for any action by the Committee. The Committee shall advise and make recommendations to the commissioners of the Carlsbad Housing and Redevelopment Commission or the City Council as either body may request on matters relating to the operations and activities of the Commission. The City Council may by resolution establish specific functions for the Committee. Failure to so Section 2: 1) Upon the effective date of this ordinance: The duties previously assigned to the Housing Commission pursuant to Chapter 2.40 as adopted by Ordinance No. 1189 shall be assumed by the Carlsbad Community Development Committee. City Council Resolution No. 5720, dated March 27, 1979, is hereby rescinded and the duties assigned the Project Area Committee pursuant thereto shall be assumed by the Carlsbad Community Development Committee. 2) INTRODUCED AND FIRST READ at a regular meeting of the Carlsbad City Council held on the 16th day of October 1979, and thereafter.
