ORDINANCE NO. 9550
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, AMENDING ORDINANCE
NO. 9321 AND SPECIFIC PLAN (SP-33) BY THE DELETION OF CERTAIN PROPERTY INCLUDED WITHIN TENTATIVE MAP (CT 79-27) AND CONDOMINIUM PERMIT (CP-44) AND ADOPTING AMENDED SPECIFIC PLAN (SP-33 (A) ) ON PROPERTY GENERALLY LOCATED WEST OF EL CAMINO REAL AND ON THE NORTH AND SOUTH SIDES OF HOSP WAY. APPLICANT: BROAD-
KOOR HOMES.
The City Council of the City of Carlsbad, California, does
ordain as follows:
SECTION 1: That Ordinance No. 9321 and Specific Plan
(SP-33) adopted thereby, is hereby amended by the deletion of
certain properties therefrom as shown on map marked (SP-33(A),
Exhibit A, attached hereto and made a part hereof.
SECTION 2: That amended Specific Plan (SP-33(A)) is hereby
adopted for the development of a 294-Unit condominium project
generally located west of El Camino Real and on the north and
south sides of Hosp Way, more particularly described on map
marked SP-33(A), Exhibit A, attached hereto and made a part
hereof.
SECTION 3: Findings: The approval of Specific Plan (SP-33(A

SECTION 4: Development conditions: The Specific Plan
(SP-33(A)) is approved subject to the following conditions and
restrictions, and the development of the property, as described
in Section 2 hereof, shall be subject to all such conditions
and restrictions which are in additional to all requirements,
limitations and restrictions of all municipal ordinances and
state and federal laws now in force or which may hereafter be
in force:
1. The property, as delineated on Exhibit A to CT 79-27/
CP-44/SP-33(A), dated February 22, 1980, shall be deleted from SP-33 upon the final approval of CT 79-27/CP-44. If CT 79-27/
CP-44 is denied, then SP-33(A) shall be denied, and the Specific Plan covering this property shall remain in existence.
SECTION 5: Administration and Enforcement. The Building
Department shall not approve any building for occupancy until
the Planning Director has certified that all the conditions of
this ordinance have been satisfied.
EFFECTIVE DATE: This ordinance shall be effective thirty
days after its adoption and the City Clerk shall certify to
the adoption of this ordinance and cause it to be published at
least once in the Carlsbad Journal within fifteen days after its
adoption.
