The City Council of the City of Carlsbad, California ereby ordains as follows: SECTION 1. That an amendment to the Contract between the ity Council of the City of Carlsbad and the Board of dministration, California Public Employees' Retirement System s hereby authorized, a copy of said amendment being attached .ereto, marked "Exhibit A', and by such reference made a part ,ereof as though herein set out in full. SECTION 2. The Mayor of the City of Carlsbad is hereby luthorized, empowered, and directed to execute said amendment 'or and on behalf of said Agency. SECTION 3. DECLARATION OF URGENCY: This is an emergency xdinance adopted as an urgency measure pursuant to California ;overnment Code Section 36937, and shall take effect immediately. rhe City has entered into agreements with the Carlsbad Police Ifficeus Association and the Carlsbad Firefighters' Association ,o provide the 1959 Servivors Program as of July 1, 1980. xder to comply with the provisions of that agreement it is necessary that this ordinance take effect immediately. THE i., CITY OF CARLSBAD The Board of Administration, Public Einployees' Retirement System, herein- ' after referred to as Board, and the governing body of above public agency, hereinafter referred to as Public Agency, having entered into a contract under date of Decembep 23, 1955, effective January I, 1956, and as amended effective July 1, 1957, Januxy 1, 1959, March 5, 1959, March 18, 1975, April I, 1975, and August 18, 1977, which provides for participation of Public Agency in said - %ystqm,'Board and Public Agency hereby agree as follows: A? Public Agency, in accordance with Section 20740, Government Code, ceased to be an lleLnployerrt for purpses of Chapter 6 of the Public Enployees' Retirment Law effective on August 18, 1977. Accumulated contributions of Public Agency as of the aforementioned date shall be fixed and determined as provided in Section 20759, Government Code, and accmulated contributions as of the aforementioned date and contributions thereafter made shall be held by the Board as provided in Section 20759, Government Code. public Agency shall contribute to said Retirement System as follos: a. With respect to miscellaneous members, the agency shall con- tribute the following percentages of monthly salaries earned as miscellaneous members of said Retirment System: 9. 10. b. C. d. (1) 0.009 percent until June 30, 2000 011 account of the liability for pior service benefits. (2) 10.177 percent on account of the liability for current service benefits. With respect to local safety members, the agency shall contribute tk following percentages of monthly salaries earned as local safety members of said Retirement System: (1) 0.018 percent until June 30, 2000 on account of the liability for prior service benefits. (2) 17.868 percent on account of the liability for current service benefits. (3) 0.500 percent on account of the liability for the 1959 Surv ivcr Progr an . A reasonable amomt per annm, as fixed by the bard to covey the costs of achinistering said System as it affects the employees of Public Agency, not including the costs of special valuations or of the periodic investigation and valuations required by law. A reasonable mount as fixed by the Board, payable in one install- ment as the occasions arise, to cover the costs of special valua- tions on accowt of employees of Public Agency, and costs of the periodic investigation and valuations required by law. Contributions required of Public Agency and its employees shall be subject to adjustment by Board on account of a-endments to the Public Etnployees' Retirement Law, and on accomt of the experience under the Retirement System as determined by the periodic investigation and valuation required by said Retirement Law.
