The City Council of the City of Carlsbad, California does xdain as follows: SECTION 1: That an amendment to the contract between the City :ouncil of the City of Carlsbad and the Board of Administration, 2alifornia Public Employees' Retirement System is hereby authorized, i copy of said amendment being attached hereto, marked Exhibit A, rnd by such reference made a part hereof as though herein set out -n full. SECTION 2: The Mayor of the City of Carlsbad is hereby ruthorized, empowered, and directed to execute said amendment for md on behalf of said agency. EFFECTIVE DATE: This ordinance shall be effective thirty days ifter its adoption, and the City Clerk shall certify to the tdoption of the ordinance and cause it to be published at least mce in the Carlsbad Journal, a newspaper of general circulation, mblished and circulated in the City of Carlsbad within fifteen lays after its adoption. Paragraphs 1 through 8 are hereby stricken from said contract as executed effective April 1, 1975, and hereby replaced by the following paragraphs numbered 1 through 10 inclusive: 1. All words and terms used herein which are defined in the Public Employees? Locdi Firemen (herein referred to as local safety members); bcal Policemen (herein referred to as local safety members); Ernployees other than local safety members (herein referred to as local miscellaneous members) In addition to the classes of employees excluded Rrom membership by said Retirement Law, the follawirg classes of employees shall not becane membws of said Retirement System: NO ADDITION4L EXCLUSIONS 4. The fraction of final ccmpnsation to be provided for local miscel- laneous membws for each year of credited prior and current service shall be that povided in Section 21251.13 subject to the reduction provided therein fa- service on and after June 1, 1955 of menbers whose service has been included in Federal Social Security, 5. The fraction of final canpensation to be provided for each year of credited prior and current service as a local safety member shall. be determined in accordance with Section 21252-1 of said Retirment Law (One-half pay at age 55) The following. additional p-ovisions of the Public Employees' Retire- ment Law which apply only upan election of a contracting agency shall apply to the Public Agency and its employees: a. Section 20952.5 (Age 50 voluntsy retirement) for local safety b. Sections 21263Y21263. I (Post-retirement survivor allowance) , for 6. members only. local safety mecnbers. Section 20020 (l'Local policeilnen shall include persms who are employed to pwform identification and comunication duties i~ the Police kpartment who are not now local saftty members'and who were in such aployment on August 4, 1972 and wb elect safety membership within 60 days of the effective date of this men&ent19 Section 20862.8 (Unused sick leave credit), for local miscel- laneous members c. d. e. Sections 21380-21388 (1959 Survivors Prograq), for local sa€ety 7. members. Public Agency, in accordance with Section 20740, C33verment Code, ceased to be an r*ernployer" fcr purposes of Chapter 6 of the Public Bnployees' Retirement Law effective on August 18, 1917. Accumulated contributions of Public Agency as of the aforementioned date shall be fixed and determined as provided in Section 20759, Goverment Code, and accmulatd contributions as of the afoxnentioned date and contributions thereafter made shall be held by the bard as provided in Section 20759, Government Code. 8. Public Agency shall contribute to said Retirement System as follom: a. With respect to miscellaneous members, the agency shall con- tribute the following prcentages of monthly salaries earned as miscellaneous members of said Retirement Systm: a 0 (1) 0.009 percent until June 30, 2000 on account of the liability for prior service benefits. 10.17'7 percent on account of the liability for current service benefits ., (2) b With respect to local safety mmbsrs , the agency shall contribute tk followirg percentages of monthly salaries earned as lxal safety members of said Retirement System: (I) 0.018 percent until June 30, 2000 on account of t'ne liability for prior service benefits. 17.868 percent on account of the liability for current service benefits. 0.500 percent on account of the liability for the 1959 Survivw Progran. (2) (3) c. A reasanable a?lount per annum, as fixed by the Board to cover the costs of adninistering said System as it affects the employees of Public Agency, not including the costs of special valuations or of the pwiodic investigation and valuations required by law. A reasnable amount as fixed by the bwd, payable in one install- ment as the occasions arise, to cove the costs of special valua- tions on account of employees of Public Rgency, and costs of the periodic investigation and valuations .required by law. d. 9. Contributions required of Public Agency and its employees shall be subject to adjustment by Board ort account of amendments to the Public Einployees' Retirement Law, and on account of the experience mder the Retirement System as determind by tk periodic investigation and valuation required by said Retirement Law. 10.
