ORDINANCE NO. 1230
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA AUTHORIZING AN AMEND- MENT TO THE CONTRACT BETWEEN CITY COUNCIL AND THE BOARD OF ADMINISTRATION OF THE CALIFORNIA PUBLIC EMPLOYEES' RETIREMENT SYSTEM.
The City Council of the City of Carlsbad, California does
xdain as follows:
SECTION 1: That an amendment to the contract between the City
:ouncil of the City of Carlsbad and the Board of Administration,
2alifornia Public Employees' Retirement System is hereby authorized,
i copy of said amendment being attached hereto, marked Exhibit A,
rnd by such reference made a part hereof as though herein set out
-n full.
SECTION 2: The Mayor of the City of Carlsbad is hereby
ruthorized, empowered, and directed to execute said amendment for
md on behalf of said agency.
EFFECTIVE DATE: This ordinance shall be effective thirty days
ifter its adoption, and the City Clerk shall certify to the
tdoption of the ordinance and cause it to be published at least
mce in the Carlsbad Journal, a newspaper of general circulation,
mblished and circulated in the City of Carlsbad within fifteen
lays after its adoption.

AMENDMENT TO COHTRACT BETWEEN THE BQARD E ADYINISTRATION
PU3LIC EMPLOYEES' RETIRmENT SYSTEM AND THE
CITY COUNCIL E THE CITY OF CARLSBAD
Thz bard of Administration, Public Employees' Retirement System, herein-
after referred to as Board, and the governing body of above public agency, hereinafter referred 'co as Public Agency, having entered into a contract under date of December" 23, 1955, effective January 1, 1956, and as anended effective
July 1, 1957, Januab-y I, 1959, March 5, 1959, March 18, 1975, April 1, 1975, and August 18, 1977, which Wovides for participation of Public Agency in said
System, Board and Public Agency hereby agree as follows:
A. Paragraphs 1 through 8 are hereby stricken from said contract as executed
effective April 1, 1975, and hereby replaced by the following paragraphs
numbered 1 through 10 inclusive:
1. All words and terms used herein which are defined in the Public
Employees? Retirenent Law shall have the meaning as defined therein

Public Agency shall participate in the Public Enployeest Retirement System frm alnd after Januzy 1, 1956 making its emplayees as hereinafter provided members of said System subject to all provisions of the Public EmployeesP Retirement Law except such as apply only on election of a contracting agency and are not Tovided for herein and to all mendnents to said Law hereafter' enacted except such as by
express provisions thereof apply only on the election of contracting agencies
Employees of Public Agency in the following classes shall becane
members of said Retiremen'c System except such in each such class as
are excluded by law or this agreement:

In addition to the classes of employees excluded Rrom membership by
said Retirement Law, the follawirg classes of employees shall not becane membws of said Retirement System:

4. The fraction of final ccmpnsation to be provided for local miscel- laneous membws for each year of credited prior and current service shall be that povided in Section 21251.13 subject to the reduction provided therein fa- service on and after June 1, 1955 of

The following. additional p-ovisions of the Public Employees' Retire- ment Law which apply only upan election of a contracting agency shall apply to the Public Agency and its employees:

Public Agency, in accordance with Section 20740, C33verment Code,
ceased to be an r*ernployer" fcr purposes of Chapter 6 of the Public Bnployees' Retirement Law effective on August 18, 1917. Accumulated
contributions of Public Agency as of the aforementioned date shall be fixed and determined as provided in Section 20759, Goverment Code, and accmulatd contributions as of the afoxnentioned date and
contributions thereafter made shall be held by the bard as provided in Section 20759, Government Code.
8. Public Agency shall contribute to said Retirement System as follom:
a. With respect to miscellaneous members, the agency shall con- tribute the following prcentages of monthly salaries earned as
miscellaneous members of said Retirement Systm:
a 0
(1) 0.009 percent until June 30, 2000 on account of the liability for prior service benefits.

b With respect to local safety mmbsrs , the agency shall contribute tk followirg percentages of monthly salaries earned as lxal safety members of said Retirement System:
(I) 0.018 percent until June 30, 2000 on account of t'ne
liability for prior service benefits.

0.500 percent on account of the liability for the 1959 Survivw Progran.

c. A reasanable a?lount per annum, as fixed by the Board to cover the costs of adninistering said System as it affects the employees of
Public Agency, not including the costs of special valuations or of the pwiodic investigation and valuations required by law.
A reasnable amount as fixed by the bwd, payable in one install-
ment as the occasions arise, to cove the costs of special valua- tions on account of employees of Public Rgency, and costs of the periodic investigation and valuations .required by law.

9. Contributions required of Public Agency and its employees shall be subject to adjustment by Board ort account of amendments to the Public Einployees' Retirement Law, and on account of the experience mder the
Retirement System as determind by tk periodic investigation and
valuation required by said Retirement Law.
10. Contributions required of Public Agenzy and its employees shall be
paid by Public Agency to the Rekirement System within thirky days after the end of tkie perid to which said contributions refer CY as may be rescribed by Board regulation.
