ORDINANCE NO. 3124
AN URGENCY ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF CARLSBAD, CALIFORNIA,
RECOGNIZING CURRENT TRAINING OF RESERVE
POLICE OFFICERS AS SUFFICIENT TO MEET
1981 POST STANDARDS
WHEREAS, the California Penal Code, as amended by
jtatutes of 1980, Chapter 1301 (AB 3217, Nolan) provides, effective
January 1, 1981, for redefinition and new authority for level 1
reserve police officers, and
WHEREAS, the City Council has determined that level 1
ceserve police officers who were certified before January 1, 1981,
3re qualified to perform general law enforcement duties by reason
2f their training and experience.
NOW, THEREFORE, the City Council of the City of Carlsbad
3oes ordain as follows:
SECTIONl: That city reserve police officers who before
January 1, 1981 were issued a level 1 reserve police officer
certificate are determined to be qualified to perform general
law enforcement duties by reason of the officers' training and
experience.
SECTION 2: Any such reserve officer meeting the
requirements of Section 1 of this ordinance shall on and after
January 1, 1981 be a peace officer as provided in Section
830.6(a)(l) of the Penal Code of the State of California during
the time in which such reserve officer is specifically assigned
police functions, and only for the duration of each such specific
assignment.

SECTION 3: This ordinance is hereby declared an
3mergency ordinance adopted as an emergency measure to protect
;he public health, safety and welfare and shall take effect
.mediately. The fact constituting the emergency are:
-) AB 3217 becomes effective January 1, 1981; 2) on that date
:eserve officers will not be qualified under Government Code
section 830.6(a)(l) unless action described in Government Code
;ection 832.6(b) is taken by the City; and 3) it is necessary
:o have a full complement of reserve police officers able to
1erfon-n specific police assignments on and after January 1, 1981
:o ensure that the City's police protection is not diminished.
SECTION 4: The City Clerk shall certify to the
rdoption of this ordinance and shall cause a copy hereof to be
mblished as required by law.
