HomeMy WebLinkAbout1980-12-16; City Council; 9570; La Costa Master Plan (MP) approval1 2 3 4 5 6 7 a 9 1c 11 12 0 15 2c 21 2: 2; 21 2: 2t 2'; 2E ORDINANCE NO. 9570 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING THE LA COSTA MASTER PLAN (M9-149 (E) ) . WHEREAS, the Planning Commission of the City of Zarlsbad, did hold a duly noticed public hearing on September 16, 1980, and subsequently adjourned hearing on October 1 and 22, 1980, to consider requests by La Costa Land Company to approve 3 revised La Costa Master Plan (MP-149 (E) ) : and WHEmAS, at the conclusion of said hearing the Planning Zommission adopted Resolution No. 1719 recommending approval of Master Plan No. MP-l49(E) based on certain findings and subject to certain conditions contained in that resolution: and WHEREAS, an Environmental Impact Report was certified as complete for a previously issued entitlement for this project and the Planning Director has found the revised Master Plan (MP-149(E)) to be in prior compliance with the City of Carlsbad Environmental Protection ordinance of 1980; and WHEREAS, the City Council of the City of Carlsbad did hold a duly noticed public hearing on November 18, 1980, and after hearing and considering the testimony and arguments if any of all persons desiring to be heard, made the following findings: 1. That the findings made by the Planning Commission in Resolution No. 1719 shall constitute the findings of the City Council. 2. That this Master Plan is consistent with provisions of Chapter 21-38 of the Carlsbad Municipal Code. 3, That in order to satisfy the General Plan i* -. -c 1 2 3 4 5 6 7 8 9 10 11 15 2c 21 2: 2; 24 2: 2c 2'; 2€ 0 requirement that public facilities be available concurrent with need, it will be necessary as a condition of this zoning approval for the developer to provide public facilities according to the approved Master Plan. NOW, THEREFORE, be it ordained by the City Council of the City of Carlsbad as follows: SECTION 1. That the revised La Costa Master Plan (MP149(E)) marked Exhibit A, dated November 18, 1980, on file with the City Clerk, and incorporated herein by this reference is approved subject to the following conditions: (1) The land use graphic (and base for other exhibits) shall be revised as follows: (A) Delete the "U" designation and applicable open space buffer from neighborhood SE-9; (B) Revise the boundaries of neighborhoods SW-1, SW-2, SW-7, SW-8, SW-9, and SW-11 to reflect natural drainage. (2) Revise the circulation graphic to show the locations of planned traffic signals as identified in the Master Plan text. (3) Revise an existing "public facility" graphic or prepare a new graphic to show the approximate locations of the planned fire stations, library branches and administrative offices. (4) Revise "topography" graphic as follows: (A) Show existing trees, location of endangered plant species discussed in the text, and any other significant natural features. (B) Indicate where significant grading (as defined by the City Engineer) is anticipated. (5) All appropriate graphics shall be revised to show -2- 1 2 3 4 5 6 7 8 9 10 11 19 20 21 22 23 24 25 26 27 28 the "Master Plan Boundary" as the external boundary of the entire La Costa community. (6) The revised graphics shall be submitted to the City Council for approval prior to the processing of any develop covered by this Master Plan. SECTION 2: That the provisions of Section 20.44.110 of the Carlsbad Municipal Code are specifically invoked. The applicant and the City shall enter into an agreement guaranteeing the provision of parks according to the provisions of the approved Master Plan. This agreement shall incorporate the appropriate pro- visions of the existing parks agreement approved by City Council Resolution No. 5286. This agreement shall be prepared and sub- mitted to the City Council for approval prior to the final approval of any development in the Master Plan area. SECTION 3: Approval of Master Plan MP-149(E) is based upon the availability of public facilities at the time of approval. If it becomes apparent that public facilities will not be available to provide for the needs of the community in the future, City Council may preclude further development under the master plan until facilities are available or impose other con- ditions to insure that public facilities will be available concurrent with need. EFFECTIVE DATE: This ordinance shall be effective thirti days after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least once in the Carlsbad Journal within fifteen days after its adoptior INTRODUCED AND FIRST READ at a regular meeting of the Carlsbad City Council held on the 7nd day of npapp , -3- 1980, and thereafter PASSED AND ADOPTED at a regular meeting of said Council held on the 16th day of -er 1980, by the following vo to wit: AYES : NOES: Council Member Lewis Counci 1 Members Packard, Cas1 er, Anear and Kul chin ABSENT: None 22 23 24 25 26 27 28 ATTEST : 1 (SEAL) -4-
