I( 1' 1; 1' 21 2 2 2 2 2 2 2 2 ORDINANCE NO. 50 61 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,: CALIFORNIA, AMENDING TITLE 6, CHAPTER 6.02, SECTION 6.02.010, OF THE CARLSBAD ElUNICIPAL CODE BY THE AMENDMENT OF SUBSECTION (C) TO REVISE THE ANNUAL INSPECTION FEES FOR RESTAURANTS. The City Council of the City of Carlsbad, California, ioes ordain as foll.ows: SECTION 1: That title 6, Chapter 6.02, Section 6.02.010 Df the Carlsbad Municipal Code by the amendment of Subsection (c) to read as follows,: "(c) Section 61.116 of the San Diego County Code of Regulatory Or,dinances adopted by reference by this Section is adended to read as follows: Sec. 61.116 Annual Inspection Fee. Every person applying for a permit under the provisions of this division shall at the time of making application for the permit pay the following annual-inspection fees: 1. // For each ,establishment, other than a vehicle or vending machine, a fee based on the average number of employees during the preceding year or, in the opinion of the Health Officer said average number does not reflect the number of employees during the year for which the permit sought with reason- able accuracy, the estimated average number of employees. For establZshments governed by the Bakery Sanitation Law : i 1 or m$re employees $ 50.00 I 1 For food establishments governed by the San Die, Code of Rekulatory Ordinances : I I or dore employees $ 30.00 For tempor:ary food concessions : 1 or dore employees $ 20.00 County For each yehicle, other than mobile food preparation units, under the same ownership and operating out of the sde estaulishment $ 30.00 For each mobile food preparation unit under the same ownership land operating out of the same establishment $215.00 For each vending machine dispensing milk, ice cream or milk products or other kinds of perishable foods or beverages, or dispensing unbottled or uncanned liquid foods or beverages, except vending machines which dispense unwrapped non-perishable, non-liquid food products $ 3.00 For each duplicate permit replacing a permit previously issued I $ 3.00 In any case where the applicant has failed for a period of 30 days to file the application and obtain the permit required by this chapter, there shall be added to and collected with the inspection fee a penalty equal to 10 percent of the fee or one dollar ($1.00) iwhichever is the greater; and for each additional month or fraction of a month after the expiration of said 30 day period that the applicant fails to file such application and obtain such permit, there shall be added to and collected with1 the inspection fee an additional penalty equal to 10 percent of the inspection fee; provided, however, in no event shall the total penalty added to the inspection fee pursuant to this section beimore than 60 percent of the inspection fee. The imposition or payment of the penalty imposed by this section shall not prevent ;the imposition of any other penalty prescribed by this chapter or! a criminal prosecution for violation of this 1 2 3 4 5 6 7 a 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 0' 0 chapter. and taxation are ;exempt from paying the fees established by this divis ion. Institytions exempt from real property assessments I I EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the a4option of this ordinance and cause it to be published at leasit once in the Carlsbad Journal within fifteen days aftelr its adoption; I INTRODUCED AND FIRST READ at a regular meeting of the Carlsbad City Council held on the 17th day of February t 1981 and thereafter PASSED AND ADOPTED at a regular meeting of said City , 1981 by the March Council held on the 3rd day of following vote, to wit: AYES : Council Members Packard, Casler, Anear, Lewis and Kulchin NOES : None ABSENT: None .
