The City Council of the City of Carlsbad, California, hereby ordains as follows: SECTION 1: That Title 18, Chapter 18.04 of the Carlsbad Municipal Code is repealed. In the case of new building, all fees required for onnection to public water systems and to sewer systems provided y entities other than the City must be paid or a bond posted efore the permit is issued. "When the Building Official issues the permit, he shall ndorse in writing or stamp on both sets of plans and specifi- ations "Approved. 'I Such approved plans and specifications hall not be changed, modified or altered without authoriza- ion from the building official, and all work shall be done in ccordance with the approved plans. "The Building Official may issue a permit for the construc- ion of part of a building or structure before the entire plans nd specifications for the whole building or structure have been ubmitted or approved, provided adequate information and detailed tatements have been filed complying with all pertinent require- ents of this code. The holder of such permit shall proceed at is own risk without assurance that the permit for the entire uilding or structure will be granted. 18.04.030 Section 303(d) amended - Expiration. Section 303(d f the Uniform Building Code is amended by the addition of the ollowing: ursuant to Chapter 18-05 of this code shall supersede Section 03(d) of the Uniform Building Code if the permit is issued pur- uant to such system, The provisions of any sewer allocation system adopted 18,04.040 Section 304(f) added - Factory Built Housing. he fees established by Section 303(a) and 304(b) for building ermits and for plan checking shall be modified for factory built ousing. The building permit fee shall be fifty per cent of the ee shown in Table 3A, and the plan check fee shall be sixty- ive per cent of the building permit fee. 18,04.050 Section. 1704 amended - Roofs. Section 1704 of he Uniform Building Code is amended to read: // -2- 1 2 3 4 5 6 7 8 9 10 11 19 20 21 22 23 24 25 26 27 28 Roof coverings shall be fire retardant except in Types 111, (1) Ordinary roof coverings may be used on buildings of (2) Class C roof coverings which comply with U.B.C. Standard IV and V buildings, where they may be as follows: Group M occupancies. No. 32-7 may be used on Group A, Division 3; Group B, Divisions 1 and 2 and Group R occupancies which are not more than two stories in height and have not more than 6,000 square feet of projected roof area and there is a minimum of 10 feet from the extremity of the roof to adjacent structures on all sides except for street fronts. Skylights shall be constructed as required in Chapter 34, Penthouses shall be constructed as required in Chapter 36. For use of plastics in roofs, see Chapter 52. For attics: Access and area, see Section 3205. For roof drainage, see Section 3207. 18.04.060 Section 2301 amended - Seismic Zone. Section 2301 of the Uniform Building Code is amended by the addition of the following: "All buildings in the City of Carlsbad are in Seismic Zone 4 . I' 18.04.070 Section 3203(h) added - Fire retardant roofs required. Section 3203 of the Uniform Building Code is amended by the addition of subsection (h) to read: "(h) Fire retardant roof coverings required. The roof covering for all structures to be constructed or relocated within 1500 feet of brush covered lands shall be fire retardant as specified in Section 3203(e). For purposes of this section "brush covered land" shall mean any area with native vegetation such as brush, chaparral, trees, scrub oak, sumac, sage, buck- wheat, greasewood, grass, weeds and other similar vegetation when such lands exceed an area of two acres or have a horizontal distance of 400 feet or more." 18.04.080 Section 3802 Amended - Automatic Sprinkler Systems. Section 3802 of the Uniform Building Code is amended to read: "(a) General. When openings in a story are provided on only one side and the opposite wall of such story is more than 75 feet from such openings, the story shall be provided with an approved automatic sprinkler system, or openings as specified above shall be provided on at least two sides of an exterior wall of the story. detached R-3 which are two or more stories in height and where the floor level of one or more stories or a basement lies below the lowest point of vehicular access for fire department apparatus as determined by the Fire Chief. (B) At the top of rubbish and linen chutes and in their terminal. rooms. Chutes extending through three or more floors shall. have additional sprinkler heads installed within such chutes at alternate floors. Sprinkler heads shall be accessible for servicing. handled shall be equipped with an approved automatic sprinkler system as specified in U.B.C. Standard No. 48-1. as defined in the Fire Code. In portions of all occupancies other than (C) All rooms where nitrate film is stored or (D) In protected combustible fiber storage vaults (A) In basements larger than 1500 square feet in floor area. (B) When the occupancy has over 10,000 square feet of floor area which can be used €or exhibition or display purposes. (D) Under the roof and gridiron, in the tie and fly galleries and in a11 places behind the proscenium wall of stages; over enclosed platforms in excess of 500 square feet in area; and in dressing rooms, workshops and storerooms accessory to such stages or enclosed platforms. EXCEPTIONS: the auditorium room on three or more sides. and their accessory rooms. with 135O F. rated heads with heat-baffle plates are installed around the entire perimeter of the stage at points not more than 30 inches below the gridiron nor more than 6 inches below the baffle plate. Under stage or under enclosed platform areas less than 4 feet in clear height used exclusively for chair or table storage and lined on the inside with materials approved for one-hour fire-resistive construction. (2) Group A Occupancies. (A) In basements larger than 1500 square feet in floor area, (B) In any enclosed usable space below or over a stairway. See Section 3308(f). (4) Group I Occupancies, (A) EXCEPTIONS : (i) In hospitals of Types 1, I1 Fire- resistive and I1 One-hour construction, the automatic sprinkler system may be omitted from operating, delivery, cardiac, X-ray and intensive care rooms and patient sleeping rooms not exceed- ing 450 square feet in area when each such room is provided with smoke detectors connected to a continuously attended sta- tion or location within the building. Increases for area and height specified in Sections 506(c) and 507 shall not apply when this exception is used. (ii) In jails, prisons and reformatories, the piping system may be dry, provided a manually operated valve is installed at a continuously monitored location. Opening of the valve will cause the piping system to be charged. Sprinkler heads in such systems shall be equipped with fusible elements or the system shall be designed as required for deluge systems in U.B.C. Standard No. 38-1. (5) Group H Occupancies. (7) Other provisions of this section notwithstanding, all occupancies except Group M where the aggregate floor area of all floors exceeds 10,000 square feet shall be provided with automatic sprinkler systems installed and maintained in operable condition as specified in this chapter. (d) PERMISSIBLE OMISSIONS, Subject to the approval of the building official with the concurrence of the chief of the fire department, sprinklers may be omitted in rooms or areas as follows : Where sprinklers are considered undesirable because of the nature or the contents or in rooms or areas which are of noncombustible construction with wholly noncom- bustible contents and which are not exposed by other areas. Sprinklers shall not be omitted from any room merely because it is damp or of fire-resistive construction. application of water or flame and water to the contents may constitute a serious life or fire hazard, as in the manufac- ture or storage of quantities of aluminum powder, calcium carbide, calcium phosphide, metallic sodium and potassium, quicklime, magnesium powder and sodium peroxide. (3) Safe deposit or other vaults of fire-resistive construction, when used for the storage of records, files and other documents, when stored in metal cabinets. (4) control of a public communication utility agency, provided: The equipment areas are separated from the remainder of the building by one-hour fire-resistive occupancy separation; and (B) Such areas are used exclusively for such equipment; and (C) An approved automatic smoke detection system is installed in such areas and is supervised by an approved central, proprietary or remote station service or a local alarm which will give an audible signal at a con- stantly attended location; and (D) Other approved fire-protection equipment such as portable fire extinguishers or Class I1 standpipes are installed in such areas. systems may be installed to protect special hazards or occu- pancies in lieu of automatic sprinklers. Any person or corporation who ~iolates any of the provisions of this chapter or Chapter 18.08 is guilty of an infraction except for the fourth or each additional Jiolation of a provision within one year which shall be a misde- neanor, Penalties for a violation of this chapter shall be as lesignated in Section 1.08.010 of this code. 18.04.110 Building numbering. Each occupancy, principal milding, structure, dwelling unit, and mobile home space Mithin the city shall be identified by a nmier or combination Df number and letter. Such numbers shall be in harmony with Scher established postal addresses in the area. Such numbers shall be a minimum of three inches in size and shall be of aontrasting colors so as to be readable from the adjoining streets, building department. Numbers shall be designated and assigned by the city 18.04.120 Street name signs. All private and public streets uithiiated street names which shall be identified by signs. names of streets shall be subject to the approval of the city planning department and the police and fire departments. and number of signs shall be as required by the city. The size and type of street signs and the Location SECTION 3: Findings. The City of Carlsbad has many large brush covered hillsides. The City is subject to a frequent Santa Ana condition of dry gusty winds which creates extreme fire danger. The City Council specifically finds that these geographic and topographic conditions necessitate greater fire protection than that provided by the Uniform Building Code, 1979 Edition. Therefore, this ordinance has altered the Code to require more fire retardant roofs and sprinklere buildings.
