The City Council finds that such fees are fairly apportioned within such
areas on the basis of benefits conferred on property proposed for subdivision
or on the need for such facilities created by the proposed subdivision and
development of other property within such areas.

EFFECTIVE DATE: This ordinance shall be effective thirty days after its
adoption, and the City Clerk shall certify to the adoption of this ordinance and
cause it to be published at least once in the Carlsbad Journal within fifteen

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, AMENDING TITLE 20, CHAPTER 20.09 OF THE
CARLSBAD MUNICIPAL CODE BY THE AMENDMENT OF SECTION
20.09.040 TO REVISE DRAINAGE FEES
The City Council of the City of Carlsbad, California, does ordain as
follows :
SECTION 1: That Title 20, Chapter 20.09 of the Carlsbad Municipal Code
is amended by the amendment of Section 20.09.040 to read as follows:
"20.09.040 Drainage Fees Established: Pursuant to Section 66483 of the
Subdivision Map Act, the following drainage fees shall be paid per gross acre
for subdivisions within the local drainage areas established herein for
purposes of defraying the costs of PLDF for the removal of surfaces and storm
waters from PLD areas as follows:
