HomeMy WebLinkAbout1982-02-16; City Council; 9612; CMC 21.06.030 amend - Hieatt rezone county to P-M-Q1 2 3 4 5 6 7 8 9 10 11 19 20 21 22 23 24 25 26 27 28 ORDINANCE NO. 9612 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 21 OF THE CARLSBAD MUNICIPAL CODE BY AMENDING THE ZONING MAP TO GRANT A PREANNEXATION CHANGE OF ZONE FROM COUNTY OF SAN DIEGO A-70-8 TO CITY OF CARLSBAD P-M-Q ON PROPERTY GENERALLY LOCATED ON THE NORTH SIDE OF PALOMAR AIRPORT. APPLICANT: HIEATT. CASE NO.ZC-241 The City Council of the City of Carlsbad, California does ordain as follows: SECTION 1: Title 21 of the Carlsbad Municipal Code is amended by the amendment of the zoning map to grant a preannexation change of zone (ZC-241) from County of San Diego A-70-8 to City of Carlsbad P-M-Q on property as shown on the map marked ZC-241, Exhibit A, attached hereto and made a part hereof, and more particularly described as: All that portion of Lot "F" of the Rancho Agua Hedionda according to Map 823 filed November 16, 1896. SECTION 2: The Zoning Map is amended to reflect this change of zone and the following conditions, which this rezoning is subject to, shall be noted on the Zoning Map: 1. 2. I// This project is approved upon the express condition that the applicant shall pay a public facilities fee as required by City Council Policy 17, dated August 29, 1979, on file with the City Clerk and incorporated herein by reference, and according to the agreement executed by the applicant for payment of said fee; a copy of that agreement, dated Play 29, 1981, is on file with the City Clerk and incorporated herein by reference. If said fee is not paid as promised this application will not be consistent with the General Plan and approval for this project shall be void. Prior to any construction activity the boundaries of the property shall be clearly marked. b. Any construction equipment, materials, and vehicles shall be staged in areas devoid of cultural resources. c. Adjacent parcels of land shall be restricted from use as borrow pits for construction activity. d. Construction personnel shall be restricted from random grading or surface collections. EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least once in the Carlsbad Journal within fifteen days after its adoption. INTRODUCED AND FIRST READ at a regular meeting of the Carlsbad City Council held on the 2nd day of February I 1982 and thereafter PASSED AND ADOPTED at a meeting of said City Council held on the 16th day of February , 1982 by the following vote, to wit: AYES : Council Pkmbers Packard, Casler, hear, Lewis and Kulchin NOES : None ABSENT: NOne ATTEST : t5z&BcL4 XLETHA L.
