HomeMy WebLinkAbout1982-08-03; City Council; 9635; Airport Business Center SPI. 2 3 4 5 6 7 8 9 10 11 19 20 21 22 23 24 25 26 27 28 ORDINANCE NO. 9635 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A SPECIFIC PLAN FOR THE AIRPORT BUSINESS CENTER SP-181. The City Council of the City of Carlsbad, California, does ordain as follows: SECTION 1: That the specific plan for the Airport Business Center (SP-181), dated May 26, 1982, a copy of which is on file with the City Clerk and is incorporated by reference, is approved . SECTION 2: That the findings and conditions contained in Planning Commission Resolution No. 1975 dated June 9, 1982 and on file in the Planning Department, are incorporated by reference as the findings and conditions for this approval. SECTION 3: That prior to the approval of the final map for this project the applicant shall enter into an agreement satisfactory to the City Attorney to hold the City harmless from liability for personal injury or property damage, or liability resulting from inverse condemnation caused by or resulting from the operating of Palomar Airport or aircraft using Palomar Airport or from the approval of this project. This condition shall apply to that portion of the project located within the FAA "clear zone" or "crash zone" of the airport as identified by the Environmental Impact Report. EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least once in the Carlsbad Journal within fifteen days after its adoption. INTRODUCED AND FIRST READ at a regular meeting of the Carlsbad City Council held on the 20th day of July , 1982, and thereafter PASSED AND ADOPTED at a regular meeting of said City Council held on the 3rd day of August , 1982, by the following vote, to wit: AYES : Comcil Wers Casler , Lads, Chick and hear SLER, Mayor ATTEST: (SEAL) 2. 6
