ORDINANCE NO. 1261
AN ORDINANCE QF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING VARIOUS TITLES IN THE CARLSBAD MUNICIPAL CODE BY THE AMENDMENT OF SEVERAL SECTIONS TO CORRECT ASSORTED POSITION AND DEPARTMENTAL DESIGNATIONS.
The City Council of the City of Carlsbad, California does ordain as
f 01 1 ows :
SECTION 1: That title 2, Chapter 2.08, Section 2.08.050, of the Carlsbad Municipal Code is amended to read as follows:
"2.08.050 Location of city offices -- Office hours. The office for the conduct of business of the city clerk, city treasurer, building and planning director and city engineer shall be located in such place as the city council by resolution may establish. Such resolution shall be passed at least two weeks in advance of any change and to be published once in a legal newspaper of general circulation of the city. Such office shall be kept open for the transaction of official business between the hours of eight a.m.
and five p.m., Saturdays, Sundays and legal holidays excluded."
SECTION 2: That Title 2, Chapter 2.24, Section 2.24.030 of the Carlsbad Municipal Code is amended to read as follows:
"2.24.030 Absence from meetings. If a member of the planning commission is absent from three successive meetings of the commission without cause, the land use planning manager shall inform the mayor of such absence, who may therewith remove the member from the commission without further notice."
SECTION 3: That Title 2, Chapter 2.44, Section 2.44.030 of the Carlsbad Municipal Code is amended to read as follows:
"2.44.030 City service. The provisions of this chapter shall apply to all offices, positions and employees in the service of the city, except :
El ective officers; Members of appointive boards, commissions and committees; Persons engaged under contract to supply expert, professional or technical services for a definite period of time; Volunteer personnel who receive no regular compensation from the city; City manager; Assistant city manager; Administrative assistants; All department heads hired on or after November 1, 1975; City attorney; Assistant city attorney;

(11) Emergency employees who are hired to meet the immediate requirements of any emergency condition, such as extra- ordinary fire, flood or earthquake which threatens life or property;
(12) Employees, other than those listed elsewhere in this section, who are employed less than half time, which is defined as employees who are expected to or do work less than one thousand forty hours in any one fiscal year."
SECTION 4: That Title 2, Chapter 2.48, Section 2.48.030(7) of the Carlsbad Municipal Code is amended to read as follows:
"2.48.030 Definitions.
(7) 'Employee, management' means any employee having signifi- cant responsibility for formulating and administering city policies and programs, including but not limited to the fo11 owi ng posit i ons :

SECTION 5: That Title 5, Chapter 5.04 of the Carlsbad City Flunicipal Code is amended by the amendment of Sections 5.04.120 and 5.04-142 to delete the designations of "building inspectorN and "publ ic works director", respectively, and insert the position designations of "building and- planning director" and "maintenance director" , respectively.

SECTION 6: That Title 5, Chapter 5.24 of the Carlsbad Municipal Code is

SECTION 7: That Title 5, Chapter 5.18 of the Carlsbad Municipal Code is amended by the amendment of Section 5.15.050 to delete the designations of the "planning and building departments", and insert the designations of the "land use planning officelland theatbuilding and planning department."
SECTION 8: That Title 6, Chapter 6.08 of the Carlsbad Municipal Code is amended by the amendment of Sections 6.08.20, 6.08.060, 6.08.100, 6.08.170, and 6.08.200 to delete the designations of "public works director'' and "building inspector", and insert the position designations of "maintenance director" and "building and planning director" respectively, wherever appear- ing in the sections.
SECTION 9: That Title 6, Chapter 6.12 of the Carlsbad Municipal Code is amended by the amendment of Sections 6.12.070, 6.12.080, 6.12.100, and 6.12.110 to delete the designation of "building inspector", and insert the position designation of "building and planning director'' wherever appearing in the sections.
SECTION 10: That Title 6, Chapter 6.16 of the Carlsbad Vunicipal Code is amended by the amendment of Sections 6.16.030 and 6.16.050 to delete the designation of "city building inspector" and insert the position designation
of "building and planning director" wherever appearing in the sections.
SECTION 11: That Title 8, Chapter 8.17 of the Carlsbad Municipal Code is amended by the amendment of Section 8.17.018 to delete the designation of "director of public works", and insert the position designation of "maintenance director."
SECTION 72: That Title 10, Chapter 10.40 of the Carlsbad Municipal Code is amended by amendment of Section 10.40.130 to delete the designation of
"publ ic works department", and insert the position designation of ''maintenance director. I'

SECTION 14: That Title 13, Chapter 13,20 of the Carlsbad Municipal Code
is amended by the amendment of Sections 13.20.020(7) and 13,20.040(-a) to delete the designation of "city building departmentn, and insert the position designation of "building and planning director" wherever appearing in the sections.
SECTION 15: That Title 14, Chapter 14.04 of the Carlsbad Nunicipal Code is amended by the amendment of Section 34.04.010(4) to delete the designation of "pub1 ic works department", and insert the designation of "utilities department. I'
SECTION 16: That Title 14, Chapter 14.08 of the Carlsbad Municipal Code is amended by the arnendment of Section 14.08.100 to delete the designation of "public service department", and insert the designation of "finance department. I'
SECTION 17: That Title 18, Chapter 18.04 of the Carlsbad Municipal Code is amended by the amendment of Sections 18.04.020, 18.04.080(b)(7)[iii) , 18.04.110, and 18.04.120 to delete the designations of "building official", "city building department" and "city planning department" respectively, and insert the designations of "building and planning director" and "land use planning office", respectively, wherever appearing in the sections.
SECTION 18: That Title 18, Chapter 18.05 of the Carlsbad Municipal Code is amended by the amendment of Section 18.05.020(1) to delete the designations of "building department" and "director of building and housing" and insert the position designation of "building and planning director."
SECTION 19: That Title 18, Chapter 18.08 of the Carlsbad Municipal Code is amended by the amendment of Section 18.08.020 to delete the designation of ''director of building and housing" and insert the position designation of "building and planning director."
SECTION 20: That Title 18, Chapter 18.16 of the Carlsbad Runicipal Code is amended by the amendment of Section 18.16.030 to delete the designation of "building official" and insert the position designation of "building and planning director."
SECTION 21: That Title 18, Chapter 18.17 of the Carlsbad Municipal Code is amended by the amendment of Section 18.17.020 to delete the designation of "director of building and housing" and insert the position of "building and planning director."
SECTION 22: That Title 18, Chapter 18.18 of the Carlsbad Municipal Code
is amended by the amendment of Section 18.18.020 to delete the designation of ''director of building and housing" and insert the position designation of "building and planning director."

SECTION 23: That Title 18, Chapter 18..20 of the Carlsbad Municipal Code is amended by the amendment of Sections 18.20.010, 18.20.030, 18.20,040, 18.20.060 and 18.20.080 to delete the designations of "director of building and housing" and "build-ing official" and insert the position designation of "building and planning director" wherever appearing in the sections.
SECTION 24: That Title 18, Chapter 18.24 of the Carlsbad Municipal Code is amended by the amendment of Sections 18.24.010, 18.24.020, 18.24.040, 18.24.050, 18.24.060 and 18.24.070 to delete the designation of "building official" and insert the position designation of "building and planning director" wherever appearing in the sections.
SECTION 25: That Title 18, Chapter 18.28 of the Carlsbad Municipal Code is amended by the amendment of Section 18.28.050 to delete the designation of "building official" and insert the position designation of "building and planning director" wherever appearing in the section.
SECTION 26: That Title 18, Chapter 18.30 of the Carlsbad Municipal Code is amended by the amendment of Section 18.30.020(b) to delete the designation of "building official" and insert the position designation of "building and pl anni ng director.
SECTION 27: That Title 18, Chapter 18.32 of the Carlsbad Municipal Code is amended by the amendment of Section 18.32.010 to delete the designation of
"city building department" and insert the position designation of "building and planning director."
SECTION 28: That Title 18, Chapter 18.36 of the Carlsbad Municipal Code is amended by the amendment of Sections 18.36.010, 18.36.050 and 18.36.060(d) to delete the designation of "director of building and housing", and insert the position designation of "building and planning director" wherever appear- ing in the sections.
SECTION 29: That Title 18, Chapter 18.40 of the Carlsbad Nunicipal Code is amended by the amendment of Section 18.40.110 to delete the designation of "director of building and housing", and insert the position designation of "building and planning director."
SECTION 30: That Title 19, Chapter 19.04 of the Carlsbad Municipal Code is amended by the amendment of Sections 19.04.068(d), 19.04.115 and 19.04.200 to delete the designations of "planning director", "manager" and "planning department" , respectively, and insert the designations of "land use planning manager" and "land use planning office" , respectively, wherever appearing in the sect ions.

SECTION 37: That Title 21, Chapter 21.07 of the Carlsbad Municipal Code is amended by the amendment of Section 21.07.120 to delete the desig- nation of "planning director", and insert the position designation of "land use planning manager" wherever appearing in the section.
SECTION 38: That Title 21, Chapter 21.08 of the Carlsbad Municipal Code is amended by the amendment of Section 21.08.100 to delete the designation of "planning director", and insert the position designation of "land use planning manager" wherever appearing in the section.

Code is amended by the amendment of Sections 21.70.010, 21.70.030, 21.70.050, 21.70.060 and 21.70.140 to delete the designation of "planning director", and insert the position designation of "land use planning manager" wherever appearing in the sections.
EFFECTIVE DATE: This ordinance shall be effective thirty days after
its adoption, and the city clerk shall certify to the adoption of this
ordinance and cause it to be published at least once in the Carlsbad
Journal within fifteen days after its adoption.
INTRODUCED AND FIRST READ at a regular meeting of the Carlsbad City
Council held on the 21st day of Deemher , 1982, and thereafter,
PASSED AND ADOPTED at a regular meeting of said city council held
on the 4th day of ~an~ary , 1983, by the following vote, to wit:
