HomeMy WebLinkAbout1983-03-01; City Council; 7065; CMC 13.04/.16 adds - Industrial waste discharge revisionc 1 2 3 4 5 6 7 a 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 ORDINANCE NO. 7065 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD CALIFORNIA AMENDING TITLE 13, CHAPTERS 13.04 AND 13.16 OF THE CARLSBAD MUNICIPAL CODE BY THE ADDITION OF SECTION 13.04.050(f)(15), THE AMENDMENT OF SECTION 13.16.060 AND THE ADDITION OF SECTIONS 13.16.051, 13.16.052, 13.16.053 AND 13.16.054, TO MSE THE INDUSTRzaL WASTE DISCEBRGE RXXJIATIONS. WHEREAS, the City Council of the City of Carlsbad is member agency of the Encina Water Pollution Facilities Joint Powers Agency and; WHEREAS, the Encina Water Pollution Facility is undergoing Phase I11 expansion which is grant funded by the United States Government and the State of California and; WHEREAS, the City of Carlsbad Code must bein full compliance with Environmental Protection Agency rules and regulations, The City Council of the City of Carlsbad, California does ordain as follows : Section 1: That Title 13, Chapter 13.04, Section 13.04.050(f) of the Carlsbad Municipal Code is amended by the addition of subparagraph (15) to read as follows: (15) Water or wastes containing substances which are not amenable to treatment or reduction by the treatment processes employed, or are amenable to treatment only to such degree that: A) The resulting effluent cannot meet the waste discharge requirements of the Regional Water Quality Control Board or other agencies having jurisdiction over the quality and protection of the receiving waters of B) The resulting sludge cannot meet limits for the chosen disposal method. Section 2: That Title 13, Chapter 13.16 of the Carlsbad Municipal Code is amended by the addition of sections 13.16.051, 13.16.052, 13.16.053 and 13.16.054 to read as follows: 13.16.051 Pretreatment Plans Required In the event the Engineer Y *z 1 2 3 4 5 6 7 E 9 1c 11 12 12 14 1: IC 17 1E 1I 2c 21 2; 21 24 2: 2( 2'; 2t determines that pretreatment is required to make the waste acceptable, the applicant shall be so notified and shall submit suitable engineering plans and specifications showing in detail the proposed pretreatment facilities and pretreatment operational procedures which shall then be included within and become a part of the original application. such plans, specifications and operational procedures have been reviewed and approved by the Engineer. A permit shall not be issued until 13.16.052 Self-Monitoring and Reporting: All Industrial Users shall be subject to self-monitoring and reporting requirements. The requirements for each applicable user shall be determined by the Engineer and included in the user's discharge permit. 13.16.053 Public Access to Information: Information and data provided by an Industrial User identifying the nature and frequency of a discharge shall be available to the public without restriction. submitted or which may be furnished by a user in connection with required periodic reports shall also be available to the public unless the user or other interested person specifically identifies and is able to demonstrate to the satisfaction of the Engineer that the disclosure of such information or a Any information or data which is particular part thereof to the general public would divulge methods or processe: entitled to protection as trade secrets. 13.16.054 Revisions to Permits: The Engineer shall be empowered to revise discharge permit requirements to comply with evolving Federal law. revisions or modifications shall not be inconsistent with applicable Federal Pretreatment Standards. Permit Section 3: That Title 13, Chapter 13.16 of the Carlsbad Municipal Code is amended by the amendment of section 13.16.060 to read as follows: 13.16.060 Permit expiration, revocation or suspension: Any permits issued in accordance with the provisions of this chapter shall be valid for a 1 2 3 4 5 6 7 a 9 10 11 1% 12 14 1E 1E 17 1€ 15 2( 21 2; 21 24 2: 2t 2: 2t * period of three years and are not transferrable unless such permit is revoked or suspended as provided in this title and in the rules and regulations adopted pursuant thereto. EFFECTIVE DATE: This Ordinance shall be effective thirty days after its adoption and the City Clerk shall certify to the adoption of this Ordinance and cause it to be published at least once in the Carlsbad Journal within fifteen days after its adoption. INTRODUCED AND FIRST READ at a regular meeting of the Carlsbad City Council held on the 15th day of February , 1983, and thereafter.
