ORDINANCE NO. 9689
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, AMENDING A SPECIFIC PLAN (SP-182) AS ADOPTED
BY ORDINANCE NO. 9618 FOR AN OFFICE DEVELOPMENT ON
APPROXIMATELY EIGHT ACRES KNOWN AS ELM GARDEN OFFICES
GENERALLY LOCATED ON THE EAST SIDE OF EL CAMINO REAL NORTI
OF ELM AVENUE.

FrmEREAS, the City Council of the City of Carlsbad,
California by the adoption of Ordinance No. 9618 approved a
specific plan (SP-182) for an office development on approximately
eight acres to be known as the Elm Garden offices; and
WHEREAS after procedures in accordance with the
requirements of law the City Council has determined that the public
interest indicates that certain amendments be made to said plan
NOW, THEREFORE, the City Council of the City of Carlsbad
does ordain as follows:
SECTION 1: That specific plan SP-182 entitled Elm Garden
Offices specific plan dated April 20, 1982, as adopted by Ordinanc,
No. 9618 is hereby amended a shown on the document marked Exhibit i
to Ordinance No. 9689 attached hereto and made a part hereof.
Except for said amendments, Ordinance No. 9618 and the Elm Garden
Offices specific plan (SP-182) and all the terms and conditions
thereof shall remain in full force and effect.

EFFECTIVE DATE: This ordinance shall be effective thirty
days after its adoption, and the City Clerk shall certify to the
adoption of this ordinance and cause it to be published at least
once in the Carlsbad Journal within fifteen days after its
adoption.

INTRODUCED AND FIRST READ at a regular meeting of the
larlsbad City Council held on the 7th day of June I
983, and thereafter
PASSED AND ADOPTED at a regular meeting of said City
louncil held on the 21st day of June , 1983, by the
iollowing vote to wit:

(subdivision) of the Municipal Code and the filing of a new specific plan.

The revised Condition No. 11 is approved as follows:
Specific Plan 182 is approved for application to all
lots within the boundaries of the plan. of the boundaries of said lots and any subdivision of the existing lot or lots shall be performed subject to the terms and conditions of this Specific Plan, which
terms and conditions shall run with each such lot and shall be binding upon the owners thereof and upon the heirs, SUCC~SSO~S and assigns of such owners.
Any adjustment
The following condition is hereby added to Specific Plan ?82:
Parking and site access will be developed per the conditions of the original Specific Plan except that an agreement establishing reciprocal access and parking across all lots created shall be executed prior to approval of a final map. Said agreement shall be reviewed and approved by the City Attorney's Office.
