ORDINANCE NO. 9735
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, ADOPTING A MASTER PLAN FOR
THE KELLY RANCH PROPERTY CONTAINING 433 ACRES ON
PROPERTY GENERALLY LOCATED BETWEEN THE EASTERLY
EDGE OF AGUA HEDIONDA LAGOON AND EL CAMINO REAL
IN THE P-C ZONE.
APPLICANT: CAL COMMUNITIES, INC.
CASE NO.: MP-174
The City Council of the City of Carlsbad, California
does ordain as follows:
WHEREAS, the findings of the Planning Commission
contained in Resolution No. 2332 constitute the findings of the
City Council in this matter.
SECTION 1: That Master Plan MP-174 Kelly Ranch as
contained in the document marked Exhibit "A",dated September 4,
1984, attached hereto and made a part hereof is hereby adopted
for the property described in said plan.
SECTION 2: That Master Plan MP-174 is approved subject
to all applicable requirements of the Carlsbad Municipal Code
and shall be effective 30 days from the date of this Ordinance.
EFFECTIVE DATE: This ordinance shall be effective
thirty days after its adoption, and the City Clerk shall certifl
to the adoption of this ordinance and cause it to be published
at least once in the Carlsbad Journal within fifteen days after
its adoption.

INTRODUCED AND FIRST READ at a regular meeting of the
Carlsbad City Council held on the 18th day of September I
1984, and thereafter
PASSED AND ADOPTED at a regular meeting of said City
Council held on the 25th day of September , 1984 by the
following vote, to wit:
AYES: Council Members Casler, Lewis, Kulchin and Chick
NOES: None
ABSENT: Council Member Prescott

Changes to Kelly Ranch Master Plan (MP-174)
1. Page 7 - Measure No. 3 - Delete the following wording:
"Where economically feasible, drainage facilities shall be designed to prevent petroleum residues created by any development within this project from draining into the wetlands . "

Page 15 - Planning Area A - Notes - Add:

Page 19 - Add Note #16 to read as follows:
"Development within Area A shall be subject to all provisions of Chapter 21.06 of the Carlsbad Municipal
Code. The developer shall consult with the property
owners of the existing single family development located across Park Drive in developing plans for this area."
