amendment to a previously issued permit or plan shall be accepted if a substantially similar application has been finally denied
within one year prior to the application date. Planning Manager shall determine if the subsequent application is substantially similar to the previously denied application.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA AMENDING TITLE 21, CHAPTER
21.54 OF THE CARLSBAD MUNICIPAL CODE BY THE
ADDITION OF SECTION 21 . 54.130 TO RESTRICT THE
REAPPLICATION AFTER DENIAL.
The City Council of the City of Carlsbad, California
does ordain as follows:
SECTION 1: That Title 21, Chapter 21.54 of the Carlsbac
Municipal Code is amended by the addition of section 21.54.130
to read as follows:
thirty days after its adoption, and City Clerk shall certify to
the adoption of this ordinance and cause it to be published at
least once in the Carlsbad Journal within fifteen days after its
adopt ion.
