ORDINANCE NO. 1283
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA AMENDING TITLE 3, CHAPTER 3 28
OF THE CARLSBAD MUNICIPAL CODE BY AMENDMENT OF
SECTION 3-28-130 TO AUTHORIZE THE CITY COUNCIL TO
DESIGNATE BY RESOLUTION SERVICES AND SUPPLIES
COSTING MORE THAN $10,000 BY USE OF OPEN MARKET
PROCEDURES.
The City Council of the City of Carlsbad, California
does ordain as follows:
SECTION 1: That Title 3, Chapter 3.28 of the Carlsbad
Municipal Code is amended by the amendment of Section 3.28.130
to read as follows:
3 28 1 30 Open market procedure (a) Notwithstanding Section 3.28.120 the purchasing officer may purchase supplies, services and equipment in the
open market pursuant to the procedures established in this section. The open market procedure may be utilized when the estimated value of the supplies, services and equipment to be purchased is less than $10,000, when no bids are received pursuant to bid procedures established by this chapter or when all bids received substantially exceed the City's estimated cost for the purchase. Further, the City Council may designate types or classes of supplies, services an-d equipment costing more than $10,000 which may be purchased through use of open market
procedures whenever the City Council finds that use of open market procedures is economically advantageous to the City.

EFFECTIVE DATE: This ordinance shall be effective
thirty days after its adoption, and the City Clerk shall certify
to the adoption of this ordinance and cause it to be published at
least once in the Carlsbad Journal within fifteen days after its
adoption.
INTRODUCED AND FIRST READ at a regular meeting of the

PASSED AND ADOPTED at a regular meeting of said City
Council held on the 17th day of September I 1985 by the
