ORDINANCE NO. 9787
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSRAD, CALIFORNIA AMENDING TITLE 21 OF THE
CARLSBAD MUNICIPAL CODE BY AMENDING THE ZONING
MAP TO GRANT A CHANGE OF ZONE FROM R-A-10 TO
C-2-Q ON APPROXIMATELY 3.67 ACRES OF PROPERTY
GENERALLY LOCATED AT THE COUNTRY STORE ON EL
CAMINO REAL SUBJECT TO CERTAIN CONDITIONS. ZC-326 - COUNTRY STORE.
The City Council of the City of Carlsbad, California
does ordain as follows:
SECTION 1: That Title 21 of the Carlsbad Municipal Code
is amended by the amendment of a zoning map for a zone change
from R-A-10 to C-2-Q on property as shown on the map marked
ZC-326, Exhibit A, attached hereto and made a part hereof.
SECTION 2: That the change of zone approved by this
ordinance is subject to the following conditions :
1. The property owner shall dedicate all access rights from the property to El Camino Real including the relinquishment of the two existing driveways. Access shall be provided in a new driveway on the easterly boundary of the property unless otherwise approved by the City of Carlsbad as a part of the site development plan. 2. The property owner shall pay for a traffic study as required by the City Engineer to determine the design of the access to the property. The study shall include a determination on whether or not a traffic signal is required to accommodate the access. 3. If it is determined as a part of the site development plan approval for this project and based on the traffic study that a traffic signal is required it shall be installed at the applicant's expense. If the signal benefits property across El Camino Real the City will use its best efforts to obtain reimbursement from such properties.

4. The applicant in preparing the site development plan
All of the conditions contained in this ordinance shall
be satisfied prior to the issuance of any building permits on the
site.

EFFECTIVE DATE: This ordinance shall be effective
thirty days after its adoption, and the City Clerk shall certify
to the adoption of this ordinance and cause it to be published at
least once in the Carlsbad Journal within fifteen days after its
adopt ion.
INTRODUCED AND FIRST READ at a regular meeting of the
Carlsbad City Council on the 17th day of December I
1985, and thereafter
PASSED AND ADOPTED at a regular meeting of said City
Council held on the 7th day of January , 1986 by the
following vote, to wit:
