ORDINANCE NO. 9819
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA APPROVING SPECIFIC PLAN SP-200
FOR CARLSBAD AIRPORT BUSINESS CENTER, AN INDUSTRIAL
PARK, ON 187 ACRES OF PROPERTY GENERALLY LOCATED ON
THE NORTH SIDE OF PALOMAR AIRPORT ROAD, A HALF MILE
EAST OF EL CAMINO REAL.
APPLICANT: CARLSBAD AIRPORT BUSINESS CENTER

WHEREAS, the City Council of the City of Carlsbad,
California, has reviewed and considered a Specific Plan for
future development of the site; and
WHEREAS, after procedures in accordance with the
requirements of law the City Council has determined that the
public interest indicates that said plan be approved.
NOW, THEREFORE, the City Council of the City of Carlsbac
does ordain as follows:
SECTION 1: The Carlsbad Airport Business Center
Specific Plan, SP-200, dated September 8, 1986, on file in the
Planning Department and incorported by reference herein is
approved. The Specific Plan shall constitute the zoning for thi:
property and all development of the property shall conform to thc
plan.
SECTION 2: That the findings and conditions of the
Planning Commission as contained in Resolution No. 2609, attachec
hereto, and incorporated herein by reference shall constitute thc
findings and conditions of the City Council except as follows:
1. Amend Condition #11 to read as follows:
"Building permits for the western one half of the property
Lots 1-22 may be issued provided the CC&R's have been
approved and all public improvements have been installed as
required by CT 74-21 for said property. Building permits foi
the remaining property may be issued provided the CC&R's havc

been approved and all public improvements have been installed
for said property. Public improvements shall include sidewalks on both sides of Loker and El Fuerte Streets for
the respective properties . "
2. Delete Conditions #12 and #13.
3. Amend Condition #14 to change the word 'hydroseeded' to ' seeded. '
4. Add Condition #19 to read as follows:
"The northern 400 acres of this property which has been included in this specific plan shall be subject to the provisions of Chapter 21.90 of the Carlsbad Municipal Code. The southern 187 acres may be developed pending approval of the local facilities plan for the area provided the developer complies with all other applicable provisions of said chapter. 'I
5. Add Condition #20 to read as follows:
"NO building in this specific plan area shall exceed 35 feet in height.
EFFECTIVE DATE: This ordinance shall be effective
thirty days after its adoption, and the City Clerk shall certify
to the adoption of this ordinance and cause it to be published
at least once in the Carlsbad Journal within fifteen days after
its adoption.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING
APPROVAL OF SPECIFIC PLAN 200, FOR A 137 ACRE 38-LOT INDUSTRIAL PARK LOCATED ON THE NORTH SIDE _- - OF PALOMAR AIRPORT ROAD, BISECTING THE FUTURE EL FUERTE STREET. APPLICANT: CARLSBAD AIRPORT BUSINESS CENTER
CASE NO: SP-200
WHEREAS, a verified application for certain property, to
wit:
LOTS 1-38, INCLUSIVE OF CARLSBAD TRACT NO. 74-21, IN THE CITY OF CARLSBAD, COUNTY OF SAN DIEGO, STATE OF CALIFORNIA, ACCORDING TO MAP THEREOF NO. 10372, FILED IN THE OFFICE OF THE COUNTY RECORDER OF SAN DIEGO COUNTY,
APXIL 13, 1982.,
has been filed with the City of Carlsbad, and referred to the
Planning Commission; and
WHEREAS, said verified application constitutes a request as
provided by Title 21 of the Carlsbad Municipal Code; and
WHERdAS, the Planning Commission did, on the 17th day of
SEPTEMBER, 1966, hold a duly noticed public hearing as prescribed
by law, to consider said request; and
WHEREAS, at said public hearing, upon hearing and consider-
in& all testimony and arguments, if any, of all persons desiring to
be heard, said Commission considered all factors relating to the
Specific Plan; and
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commis-
sion as follows:
(A) That the foregoing recitations are true and correct.
(B) That based on the evidence presented at the public hearing, the Commission recommends APPROVAL of SP-200, based on the
following findings and subject to the following conditions:

The site is physically suitable for the type and density of
the development since the site is adequate in size and shape to accommodate industrial development at the density pro- posed.
The project is consistent with all City public facility policy and odinances because the Specific Plan prohibits any development on the site without the proper public improvements.
The proposed use will not be detrimental to adjoining
properties for the reasons identified in the staff report.
The environmental effects of this project have been considered
in conjunction with previously certified environmental
documents and a notice of Prior Compliance has been issued by
the Planning Director on August 23, 1986 and approved by the
Planning Commission on September 17th, 1986,
The Specific Plan is consistent with the PI designation on the Carlsbad General Plan, wth the provisions of the PM Zone, and with Sections 65451 and 65452 of the Government Code which
regulate the use of specific plans.
CONDITIONS:
Approval is granted for the attached ordinance, attached as Exhibit "A", , dated September 8, 1986, incorporated by reference and on file in the Planning Department. Development shall occur substantially as shown unless otherwise noted in
these conditions.
All standards and provisions established in the document
entitled "Carlsbad Airport Business Center Specific Plan", dated September 8, 1986, and incorporated by reference, shall
be met by any future development occurring within the boundaries of this Specific Plan.
Tnis project is also approved under the express condition that the applicant pay the public facilities fee adopted by the
City Council on April 22, 1986 and any development fees
established by the City Council pursuant to Chapter 21-90 of
the Carlsbad Municipal Code or other ordinance adopted to
implement a growth management system or facilities and
improvement plan and to fulfill the subdivider's agreement to
pay the public facilities fee dated September 10, 1986 and the
agreement to pay the Growth Management Fee dated September 10,
1986, copies of which are on file with the City Clerk and are
incorporated by this reference. If the fees are not paid this
application will not be consistent with the General Plan and approval for this project shall be void.

Engineering Department:
Driveway locations shall conform to the Exhibit "A", dated
September 8, 1986, attached hereto and made a part of this
Specific Plan. Changes to these locations shall require an
amendment to this plan unless otherwise approved by the City
Engineer.
Reciprocal access shall be granted across adjacent lots where practical.
Prior to issuance of building permits, sight corridor
easements shall be established on all corner lots within this
Specific Plan in accordance with design criteria applicable at
the time or approval of site plans.
Prior to issuance of building permits, a sewer study shall be completed to ascertain that there is adequate sewer capacity
to service this project.
This project is approved upon the express condition that building permits will not be issued for development of the subject property unless the City Engineer determines that sewer capacity is available at the time of application for
such permits and will continue to be available until time of
occupancy.
Pretreatment of the sanitary sewer discharge from this project is required. In addition to the requirements for a sewer
connection permit the developer shall conform to the
requirements of Chapter 13.16 of the Carlsbad Municipal Code. The developer shall apply for an industrial waste dischar5e permit concurrently with the building permit for this project. No Certificates of Occupancy for the project will be issued
before the industrial waste discharge permit application
requirements have been met, all applicable fees paid and the
permit issued.
The developer shall comply with all the rules, regulations and
design requirements of the respective sewer and water agencies
regarding services to the project.
Prior to issuance of any building permit, all public
improvements as required by Carlsbad Tract 74-21 shall be
installed. This shall include all Loker Avenue to join
Palomar Airport Road to the East and to the West.
Sidewalks constructed to City standards shall be located on both sides of Loker and El Fuerte Streets prior to occupancy of any buildings.
Loker Street shall be completed to the satisfaction of the
City Engineer prior to occupancy of any buildings.

All graded areas shall be hydroseeded when required to the satisfaction of the City Engineer.
All structures shall conform to all FAA regulations and to
the McClellan - Palomar Airport Comprehensive Land Use Plan.
Before and as a condition of obtaining a final map, or final
development permit or site plan approval under Title 21 of the
Carlsbad Municipal Code, the subdivider shall enter into a contract with the City whereby the subdivider covenants on behalf of the subdividers and subdivider's successors in
interest to the following:
a) No opposing and consenting to the formation of a bridge and major thoroughfare district for the southern area of
the City.
b) Payment of the bridge and major thoroughfare fee for the area of the district in which this development is
located.
c) Payment of the traffic impact fee established for the area
of the City in which the development is located.
Fire Department:
17) Prior to issuance of building permits, the developer shall
submit to the Fire Department a map, showing the street
network, conforming to the following criteria:
* 400' scale (1:4800) * Photo reduction on mylar * At least two existing streets and/or intersections shall
be referenced on the map (not a separate vicinity mp)
-?; Maps shall include at least the following information: * Street centerlines * Street names * Fire hydrant locations
18) The applicant shall agree to pay a fee established to cover
the cost of updating Fire Department response maps.
