HomeMy WebLinkAbout1987-06-16; City Council; 3213; CMC 11.24.145 add - Carlsbad seawall pedestrian only rqmt1 2 3 4 5 6 7 E s 1c 13 12 t 1E 15 2( 21 2: 21 24 2f 26 2'; 2E 0 e ORDINANCE NO. 3213 AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 11, CHAPTER 11.24 OF THE CARLSBAD MUNICIPAL CODE BY THE ADDITION OF SECTION 11.24.145 TO IMPOSE A PEDESTRIAN ONLY REQUIREMENT ON THE CARLSBAD WHEREAS, the City of Carlsbad has just completed and opened to the public a walkway along the seawall adjacent to the Carlsbad State Beach between Tamarack Avenue and Pine Street in the City of Carlsbad; and WHEREAS, the walkway is narrow and constrained by walls on both sides, it is being used by bicyclist and skateboarders which conflicts with the safe passage of pedestrians creating the potential for injury to persons using the walk; and WHEREAS, it is necesary that this ordinance be effective immediately upon adoption in order to protect the health and safety of the community, by preventing and protecting persons from injury, NOW, THEREFORE, the City Council of the City of Carlsbad, California does ordain as follows: SECTION 1: That Title 1, Chapter 11.24 of the Carlsbad Municipal Code is amended by the addition of Section 11.24.145 to read as follows: "11.24.145 Carlsbad Seawall - Pedestrian Only. The Carlsbad Seawall sidewalk at the base of the bluff adjacent to Carlsbad State Beach between Tamarack Avenue and Pine Street shall be limited to pedestrians only. No person shall skate or use or ride any rollerskate, coaster, skateboard, bicycle, toy vehicle or any other form of transportation on the Carlsbad Seawall sidewalk." ... 1 2 3 4 5 6 7 a 9 10 11 12 D SECTION 2: This ordinance is hereby declared to be an emergency ordinance adopted as an urgency measure to protect the public health, safety and welfare and shall take effect immediately upon its adoption. The facts constituting the emergency are set forth above and represent a serious threat to the citizens of Carlsbad. EFFECTIVE DATE: This ordinance shall be effective immediately upon passage. The City Clerk of the City of Carlsbad shall certify to the adoption of this ordinance and cause it to be published once in the Carlsbad Journal within 15 days after its adoption.
