ORDINANCE NO. 9835
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AMENDING TITLE 22 OF THE
CARLSBAD MUNICIPAL CODE BY THE AMENDMENT OF VARIOUS
SECTIONS TO CLARIFY HISTORIC POINT OF INTEREST
DESIGNATION.
The City Council of the City of Carlsbad, California
does ordain as follows:
SECTION 1: That Title 22, Chapter 22.02, Section
22.02.040 of the Carlsbad Municipal Code is amended by
renumbering subsections (10) through (16) to (11) through (17)
respectively and by the addition of a new subsection (10) to read
as follows:
"Historic Point of Interest" means any property or
improvement, man-made or natural, which has special historic,
cultural, architectural, archaeological or community interest or
value as part of the development, heritage or history of the
City, the State of California, or the nation and that has been
designated a point of interest pursuant to this title.
SECTION 2: That Title 22, Chapter 22.06, Section
22.06.030 of the Carlsbad Municipal Code is amended by the
amendment of subsection (f) to read as follows:
"(f) After the public hearing, the Commission shall by
resolution make a report and recommendation to the City Council. If the Commission determines that the improvement does not meet landmark criteria, the process
shall terminate and the Commission shall notify the
property owner and applicant of such termination in
writing within ten days of the Commission's
determination. If the Commission determines that the resource warrants landmark designation and the property owner has consented to same in writing, the Commission shall submit a written recommendation to the City
Council incorporating its reasons in support of the
proposed landmark designation. Without the property owner's consent to the proposed landmark designation, a site shall not be designated a historic landmark. If
the Commission determines that the improvement warrants inclusion in the Historic Resource Inventory or the
owner has not consented to designation as a historic
landmark, the Commission may recommend that the resource be designated a historic point of interest. Permits

shall be required to work on a designated historic landmark as specified in Chapter 22.08. No permit shall
be required to work on a historic point of interest."
INTRODUCED AND FIRST READ at a regular meeting of the
Carlsbad City Council on the 1st day of September I 1987
and thereafter
PASSED AND ADOPTED at a regular meeting of said City
Council held on the 8th day of September , 1987 by the
following vote, to wit:
AYES: Council Members Lewis, Kulchin, Pettine, Mamaux and Larson
NOES: None
ABSENT: None
