HomeMy WebLinkAbout1987-12-22; City Council; 9839; Pacific Rim Country Club & Resort1 2 3 4 5 6 7 8 9 10 11 12 t 18 19 20 21 22 23 24 25 26 27 28 0 ORDINANCE NO. 9839 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA APPROVING MASTER PLAN MP-177 FOR THE PACIFIC RIM COUNTRY CLUB AND RESORT, A MIXED USE COMMUNITY CENTERED AROTJND A HOTEL AND GOLF COURSE ON PROPERTY GENERALLY LOCATED NORTH OF LA COSTA AVENUE BETWEEN 1-5 AND EL CAJ!I.INO REAL. APPLICANT: HUNT PROPERTIES CASE NO.: MP-177 WHEREAS, The City Council of the City of Carlsbad, California, has reviewed and considered a Master Plan for future development of the site; and WHEREAS, after procedures in accordance with the requirements of law the City Council has determined that the public interest indicates that said plan be approved. NOW, THEREFORE, the City Council of the City of Carlsbad does ordain as follows: SECTION 1: The Pacific Rim County Club and Resort Master Plan, MP-177 dated IIRevised November 4, 1987," on file with the Planning Director and incorporated by reference herein is approved. The Master Plan shall constitute the zoning for this property and all development of the property shall conform to the plan. SECTION 2: That the findings and conditions of the Planning Commission in Planning Commission Resolution 2594 shall also constitute the findings and conditions of the City Council with the addition of the following findings and conditions: FINDINGS 1. The Master Plan is consistent with the LCP. 2. The property owner has executed an agreement to pay the fee and that agreement has been approved by Council. 1 2 z 4 r; " E 7 E 9 1c 11 12 t 0 18 19 20 21 22 23 24 25 26 27 28 3. Payment of an agricultural conversion mitigation fee in an amount not less than $5,000 and not more than $10,000 per net converted acre has been required as a condition of the Master Plan. 4. Conversion would be compatible with continued agricultural use on surrounding lands. 5. The Master Plan provides overriding benefits to the resources of Batiquitos Lagoon. 6. The Master Plan provides significant protection and enhancement of environmentally sensitive habitats above and beyonc the existing land use controlls current requirements. CONDITIONS '*Development within this Master Plan shall utilize effluent or treated water for irrigation of the golf course and other major landscape areas maintained by the homeowners association when available from the appropriate agencies. Plans for each phase identifying these effluent irrigation areas and the location of the dual irrigation systems needed to serve them shall be submitted to the planning Director and City Engineer for approval prior to approval of the final map for each phase. The dual system shall be installed for the areas identified in the plan at the time of development even if effluent is unavailable at the time of construction." EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at least once in the Carlsbad Journal within fifteen days after its adoption. INTRODUCED AND FIRST READ at a regular meeting of the Carlsbad City Council on the 8th day of December, 1987, and thereafter PASSED AND ADOPTED at a regular meeting of the City Council of the City of Carlsbad on the 22nd day of December 1987, by the following vote, to wit: I AYES : Council Members Lewis, Kulchin, Pettine, Mamaux and Larso APPROVED AS TO FORM AND LEGALITY ATTEST: Ll.laxdQ- ALETHA L.
