NS-45 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 2, CHAPTER 2.38 OF THE CARLSBAD MUNICIPAL CODE BY THE AMENDMENT OF THE CHAPTER TITLE AND OF SECTIONS 2.38.010, 2.38.020, 2.38.030, 2.38.040, 2.38.050 AND 2.38.060 TO DELETE THE WORD "CITIZEN" FROM ALL REFERENCES RELATING TO THE CITY OF CARLSBAD'S i 1 SENIOR PROGRAM 6 11 The City Council of the City of Carlsbad, Cal ifornia, hereby ordai 7 8 fol 1 ows : 9 /I SECTION 1: That Title 2, Chapter 2.38 of the Carl sbad Municipal 10 11 12 13 14 15 is amended by the Amendment of the Chapter Title and of Sections 2.3t 2.38.020, 2.38.030, 2.38.040, 2.38.050 and 2.38.060 to read as follows: CHAPTER 2.38 SENIOR COMMISSION 2.38.010 - CREATED A senior commission of the City is created. 16 17 18 19 20 21 22 23 2.38.020 - MEMBERSHIP, The senior commission shall consist of five members who shall be res. and registered voters of the City. All commission members wi appointed by the mayor with the approval of the City Council. C commission members first appointed, two shall be for a term of three ! two shall be for a term of two years, and one shall be for a term ( year. A1 1 subsequent commission members shall be appointed for a tc three years. A commission member shall serve until reappointed c member's successor has been appointed and is qual i fied. If a v( occurs other than by the expiration of a term, the vacancy shall be . in the same manner as an original appointment to the commission. senior coordinator shall be an ex officio member of the commission, ex officio member shall not be entitled to vote on any matter befol commission. 24 25 26 27 28 2.38.030 - MEETINGS. The senior commission shall meet at such time or times as the comm may establish by rule, provided that a regular meeting shall be hc least once each month. The majority of the appointed members constitute a quorum for the purpose of transacting the business ( commission. It is the responsibility of the senior commission to make recommend; to the City Council and to advise the City Council on the special and concerns of seniors including the creation, operation, maintel management and control of senior programs, activities and facilitie: 2.38.050 - FUNDS - DISPOSITION OF MONEY. The senior commission is authorized to and may receive donations, 1 legacies, endowments or bequests made to the City or to the commissi or on behalf of the City. All donations, gifts, legacies, endowmel bequests so received by the commission shall be turned over to thc treasurer and shall be kept in a special fund to be designated i senior fund. All moneys in the fund shall be used for prom supervision and operation of senior programs. No moneys in the fund be spent without prior council authorization. 2.38.060 - POWERS DELEGATED TO COMMISSION TO BE ADVISORY. Nothing in this chapter shall be construed as restricting or curtaili of the powers of the City Council, or as a delegation to the commission of any of the authority or discretionary powers vestt imposed by 1 aw in the City Council . The City Counci 1 declares th, public interest, convenience and welfare require the appointment senior commission to act in a purely advisory capacity to the City C for the purposes enumerated.
