ORDINANCE NO. NS-43
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, AMENDING TITLE 3, CHAPTER 3 -28 OF THE CARLSBAD MUNICIPAL CODE BY THE AMENDMENT AND ADDITION OF VARIOUS SECTIONS TO ADOPT A PROCEDURE FOR THE INFORMAL BIDDING
OF PUBLIC CONSTRUCTION PROJECTS OF $50,000 OR LESS.
The City Council of the City of Carlsbad, California
ordain as follows:
SECTION I : The City Council hereby finds :
1. That it is the public interest for the City to
to become sub j ect to the Uniform Public Construction
Accounting Procedures adopted by the California Un
Construction cost Accounting Commission pursuant to Public Con
Code Section 22000 et. seq.
2. Performance of City public projects in accor
with the procedures will enable the City to perform public prc
with its own forces or by contracts awarded through inf
bidding procedures or a combination of both when it is in thc
interest of the City to do so.
3. It is the intent of the City Council that
ordinance govern the selection of contractors by the City tk
informal bidding procedures, in accordance with Public Cor
Code Section 22034.
SECTION 2: That Title 3, Chapter 3.28 of the Cal
Municipal Code is amended by the amendment of Section 3.28.(
read as follows:
3.28.080 Public Droiects. Contracts for public prc shall be governed by the ttLocal Agency Public Construction ' Division 2, Part 3, Chapters 1 and 2 of the California 1
Contract Code, 521100 et. seq.

SECTION 3: That Title 3, Chapter 3.28 of the Car
Municipal Code is amended by the addition of Section 2.28.01
read as follows:
3.28.082 Alternative Procedure - informal biddinq (a) Public projects of Fifty Thousand Dollars ($50 or less may be let to contract by informal procedures as set in this section,
(b) The selection of contractors to perform p projects pursuant to subsection (a) shall be governed b) following procedures:
(1) The Purchasing Officer shall develop a li qualified contractors eligible to submit bids on informal cont
awarded by the City. In development and maintaining the list Purchasing Officer shall use the minimum criteria specified b California Uniform Construction Cost Accounting Commi (tlCommissiontt) . In addition, the Purchasing Officer may o from the contractors' State License Board, and from constru trade associates in the county, names and addresses of qual contractors located in the county.
(2) The list shall be organized in accordance the license classifications of the Contractor's State Li Board.
(3) The Purchasing Officer shall publish annu in all those construction trade journals identified by Commission in accordance with Public Contract Code Section 2

(4) Any licensed California contractor may request be added to the list at any time.
(5) The Purchasing Officer shall deVelOF provide to contractors applying for inclusion on the 1: simplified form requesting the applicant's name, address California contractors license number and classification.
(6) The Purchasing Officer shall mail nc inviting informal bids to all contractors on the list of qual contractors, for the category of work being bid, and/ol construction trade journals specified in subsection (3).
(7) The Purchasing Officer shall completc mailing of notices inviting informal bids, as require subsection (6) not less than ten calendar days before bids arc
describe the project in general terms , how to obtain more det information about the project, and state the time and place fc receiving and opening of sealed bids.
(9) The notice inviting informal bids sha published at least 14 calendar days before the date of openir bids in a newspaper of general circulation in the City of Carl

Section 3.28.024 Emersencies. In cases of emergencies, as determined by the City Council, including bu limited to, states of emergency defined in Section 8558 o California Government Code, when repair or replacements necessary to permit the continued conduct of the operatic services a public agency or to avoid danger to life or prop' the City Council, by majority vote, may proceed at once to re: or repair any public facility without adopting the p specifications, strain sheets, or working details, or giving n
of bids to let contracts. The work may be done by day labor
the direction of the City Council, by its City Manager
contract, or by a combination of the two. The City Managl hereby delegated the power to declare the public emergency su, to confirmation by the City Council, by a 4/5 vote at its regular meeting.
Section 3.28.170 Award and execution of contracts (a) Except in emergency situations, pursuant subsection (1) of Section 3.28.090, all contracts for supp services and equipment in an estimated amount of Fifteen Tho. Dollars, or more, shall be awarded by the City Council. Cont for supplies, services and equipment in an estimated amount of than Fifteen Thousand Dollars shall be executed by the Manager.
(b) The City Manager may award contracts in an ar
of less than Twenty Five Thousand Dollars when the study or prc is financed from deposits provided by persons or organizai other than the City or when the City's share of the cost is than Five Thousand Dollars. (c) The City Manager may determine to accomplish PI projects of Fifteen Thousand Dollars or less without informal and cause them to be performed by the employees of the Cit force account, by negotiated contract, or by purchase order.
