NS-62 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA AMENDING TITLE 14, CHAPTER 14.08 OF THE CARLSBAD MUNICIPAL CODE CHAPTER 14 . 12 RELATING TO CROSS-CONNECTION CONTROL PROGRAM AND ADOPTING ARTICLE 1 OF GROUP 4 OF SUBCHAPTER 1 OF CHAPTER 5 OF TITLE 17 OF THE CALIFORNIA ADMINISTRATIVE CODE. Article I of Grc of subchapter 1 of Chapter 5 of Title 17 of the Calif( Administrative Code entitled ''Drinking Water Supplies" (17 S7583 et seq.) relating to the implementation of the c: connection program and provisions for backflow protection, te; and maintenance of records of locations, tests and repair backflow prevention devices are hereby adopted by reference supplemented and implemented by this chapter. 14.12.030 Backflow Drevention device removal. Approval must be obtained from the City before a bac prevention device is removed, relocated, or replaced. (1) The use of a devise may be discontinued an device removed from service upon presentation of suffi evidence to the City to verify that a hazard no longer exis, is not likely to be created in the future. confirmation by the City that the relocation will contint provide the required protection and satisfy install requirements. A retest will be required following the reloc of the device. (3) A device may be removed for repair, pro the water use is either discontinued until repair is complete the device is returned to service, or the service connectil equipped with other backflow protection approved by the Cit: retest will be required following the repair of the device. (4) A device may be removed and replaced pro the water use is discontinued until the replacement devic installed. All replacement devices must be approved by the and must be commensurate with the degree of hazard involved. (2 1 A device may be relocated foll 14.12.040 User supervisor. (a) At each premise, where it is necessary il opinion of the City, a user supervisor shall be designated b at the expense of the water user. This user supervisor sha responsible for the monitoring of the backflow prevention de and for avoidance of cross-connections. In the even contamination or pollution of the drinking water system due cross-connection on the premises, the City shall be pro notified by the user supervisor so that appropriate measure be taken to overcome the contamination. (b) The water user shall inform the City of the supervisor's identity (name, address and telephone number) annual basis and whenever a change occurs. 14.12.050 Water system survey. (a) The City shall review all requests for new sex to determine if backflow protection is needed. Plans specifications must be submitted to the City upon reques' review of possible cross-connection hazards as a conditil service for new service connections. (c) The City may, at its discretion, requi 14.12.060 Customer notification - device installa (a) The City will notify the water user of the s findings, listing the corrective actions to be taken if an: required. A period of ten calendar days for the water u: contact the City will be given, with thirty days to complet corrective actions required including the installation of bac devices. (b) A second notice will be sent to each water use does not take the required corrective actions prescribed i: first notice within the thirty calendar days allowed. If no action is taken within th week period, the City shall terminate water service to the aff water user until the required corrective actions are taken. 14.12.070 Customer notification - testins maintenance. (a) The City will notify each affected water user it is time for the backflow prevention device installed on service connection to be tested. (1) Refusal to install a required bac: (2) Refusal to test a backflow prevention de (3) Refusal to repair a faulty backflow preve' device. (4) Refusal to replace a faulty backflow preve device. (5) Direct or indirect connection betweer public water system and a sewer line. (6) Unprotected direct or indirect conne between the public water system and a system or equi containing contaminants. (7) Unprotected direct or indirect conne between the public water system and an auxiliary water syste (8) A situation which presents an immediate h hazard to the public water system. (c) For conditions (1) , (2) , (3) , or (4) , the City terminate service to a customerls premise after two written no have been sent specifying the corrective action needed and the period in which it must be done. If no action is taken withi allowed time period water service shall be terminated. (d) For conditions (5), (6), (7) or (8), the City take the following steps: (1) Make reasonable effort to advise water us intent to terminate water service. (2) Terminate water supply and lock service v The water service will remain inactive until correctio violations has been approved by the City. 14.12.090 Requirements for certification as a bac prevention device tester. (a) Each applicant for certification as a testt backflow prevention devices shall file an approved application the City Clerk, together with a fee of twenty five dollars. (b) Competency in all phases of backflow preve device testing and repair must be demonstrated by mean education and/or experience in order to obtain certification (c) The following are minimum requirement: (1) Applicants shall have had at least two experience in pluming or pipe fitting or equivalent qualificat (2) Applicants shall hold a valid cross-conne control certification from the American Water Works Associ (AWA), California-Nevada Section, from a county certific program, or have equivalent training in the opinion of the and the Health Department. (3) Each applicant for certification as a t of backflow prevention devices shall furnish evidence to shou he/she has available the necessary tools and equipment to pro test such devices. Fees to implement, maintain, admin and enforce this chapter shall be established by resolution o City Council. 14.12.110 Violations. It is unlawful for any pers violate any provision or fail to comply with any of requirements of this chapter. Any person violating any 0. provision or failing to comply with any of the provisions of chapter shall be guilty of a misdemeanor and shall be punish a fine of not more than $1,000 or by imprisonment in the c jail for a period not exceeding six months, or by both. 14.12.120 Severabilitv. If any section, subsec subdivision, paragraph, sentence, clause or phrase of ordinance or any part thereof, is for any reason held 1 invalid, such decision shall not affect the validity 01 remaining portions of this ordinance or any part thereof. Council hereby declares that it would have passed each sec subsection, subdivision, paragraph, sentence, clause, or ph thereof, irrespective of the fact that any one or more sect subsections, subdivision, paragraphs, sentences, clauses phrases be declared invalid." EFFECTIVE DATE: This ordinance shall be effectivet days after its adoption, and the City Clerk shall certify t adoption of this ordinance and cause it to be published at once in the Carlsbad Journal within fifteen days after adoption.
