AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING VARIOUS TITLES OF THE CARLSBAD MUNICIPAL CODE DEALING WITH CITY FEES
5 WHEREAS, the City Council of the City of Carlsbad has the authority

to establish fees for various City services; and
therefore contained within the Carlsbad Municipal Code; and * WHEREAS, said fees have in the past been set by ordinance and are

WHEREAS, the City Council has determined the necessity of removing 11
WHEREAS, the City Council is not required to set such fees by

1. Section 5.08.010 of the Carlsbad Municipal Code shall be 16

4. Section 5.08.170 of the Carlsbad Municipal Code shall be amended
as fol 1 ows :
The phrase ''seven dol 1 ars and fifty cents'' shall be repl aced by the phrase "twenty-five dollars".
5. Section 5.08.180 of the Carlsbad Municipal Code shall be amended
as fol 1 ows :
All occurrences of the phrase "twenty-five dollars" shall be replaced by the phrase "thirty dollars".
6. Section 5.08.200 of the Carlsbad Municipal Code shall be
deleted.
7. Section 8.50.030 of the Carlsbad Municipal Code shall be amended
as fol 1 ows :
The phrase "A twenty-five dol 1 ar fee" shall be repl aced by the phrase "A fee establ ished by the City Council by resolution. I'
8. Section 10.56.070 of the Carlsbad Municipal Code shall be
amended to read as fol 1 ows:
"The fees for bicycle registration and 1 icenses shall be establ i shed by the City Council by resolution. I'
9. Section 11.06.050 (f) (1) shall be amended to read as follows:
For each excavation and fill on the same site the fee shall be based on the volume of excavation or fill , whichever is greater. Before accepting a set of plans and specifications for checking, the City Engineer shall collect a plan checking fee. Separate permits and fees shall apply to retaining walls or major drainage structures as indicated elsewhere in this code. There shall be no separate charge for standard terraced drains and similar facil i ties. The amount of the plan check fee for grading plans shall be establ ished by the City Council by resolution. The fee for grading permit authorizing additional work to that under a valid permit shall be the difference between the fee paid for the original permit and the fees shown for entire project.
10. Section 11.24.020 of the Carlsbad Municipal Code shall be
amended as fol 1 ows:
1. Subsection (2) shall be amended to read as fol1 ows: The current permit fee as establ ished by the City Council by resolution must be paid.

12. Section 20.08.050 of the Carlsbad Municipal Code shall bc
amended to read as follows:
All construction and installation of improvements shall bc subject to plan review and inspection by the City Engineer 01 other appropriate department, and the subdivider shall arrangc for inspection prior to starting construction or installatiol of the improvements. The cost to the City of examininin! improvement plans, inspecting improvements and monuments shal' be paid by the subdivider. An improvement plan review fee a: established by the City Council by resolution, based on thc approved engineer's estimate of the total improvement cost, shall be paid to the Engineering Department upon submittal of improvement plans for review. An improvement constructior inspection fee in the amount established by the City Council by resolution shall be paid prior to approval of the final maF or the commencement of construction of the improvement: whichever occurs first.
13. Section 20.08.060 of the Carlsbad Municipal Code shall bf
amended as fol1 ows:
The phrase of "three hundred dollars, plus forty dollars for each offer of dedication plus forty dollars for each agreemenl to improve" shall be replaced by the phrase ''in an amounl determined by the City Council by resolution."
14. Section 20.08.070 of the Carlsbad Municipal Code shall bt
amended as fol 1 ows:
The phrase "of one hundred dol 1 ars, plus forty dollars for eack agreement to improvement, plus forty dollars for each quitcl ain of easement" shall be replaced by the phrase "in an amount determined by the City Council by resolution."

EFFECTIVE DATE: This ordinance shall be effective thirty days after
its adoption, and the City Clerk shall certify to the adoption of thi:
ordinance and cause it to be pub1 ished at least once in the Carl sbac
Journal within fifteen days after its adoption.
