AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA AMENDING TITLE 2 OF THE CARLSBAD MUNICIPAL CODE BY THE ADDITION OF
CHAPTER 2.30 CREATING A CHILD CARE COMMISSION

2.30.010 Child Care Commission created.
A Child Care Commission of the City is created.
2.30.020 Purpose. The purpose of the Child Care Commission is to advis City Council on the implementation of that portion of the Lanl
Element of the General Plan adopted to encourage and promotc
establishment of child care facilities in safe and conve:
locations throughout the community to accommodate the grl
demand for child care in the community caused by demogra]
economic and social forces.
2.30.030 Membership. The Child Care Commission shall consist of seven me] appointed by the mayor with the approval of the City Council
the members so appointed, three shall be for a term of three y’
two shall be for a term of two years, and two shall be for a
of one year. Their successors shall be appointed for a tel

2.30.040 Meetinqs. The Child Care Commission shall meet regularly 01 month, or more frequently if necessary, for the transactic
business. Its meetings shall be open to the public. The
Care Commission shall elect a chairperson and a vice-chairp’
from its membership who shall hold office for one year. The
Care Commission may establish its own rules and procel necessary for the conduct of its business. Four members constitute a quorum.

to the City Council and shall provide support, advice assistance as well as recommendations as to how to monitor evaluate child care delivery in the City. The Child Commission shall make recommendations to the City Council on
matter referred to it within 30 days. Failure to make su
recommendation to the City Council within such time period s
be deemed to be approval of the matter so referred. The
Council may by resolution establish specific functions for
Child Care Commission.
2.30.070 Powers delesated to commission to be advi: Nothing in this chapter shall be construed as restric
or curtailing any of the powers of the City Council, or delegation to the Child Care Commission of any of the authoril
discretionary powers vested and imposed by law in the City Cour The City Council declares that the public interest, conveniencc
welfare required the appointment of a Child Care Commission tc in a purely advisory capacity to the City Council for the purr enumerated herein. Any power herein delegated to the Child
Commission to adopt rules and regulations shall not be cons1 as a delegation of legislative authority but purely a deleg; of administrative authority.
2.30.080 Sunset clause. This chapter shall remain in effect only for four 1 from the date of its enactment and as of that date is repei
unless a later enacted chapter deletes or extends that date.'
EFFECTIVE DATE: This ordinance shall be effective tl
days after its adoption, and the City Clerk shall certify tc
adoption of this ordinance and cause it to be published at 1
once in the Carlsbad Journal within fifteen days after
