NS-109 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA ADOPTED AS AN URGENCY ORDINANCE EXTENDING THE TEMPORARY LAND USE CONTROLS IMPOSED BY INTERIM ORDINANCE NO. NS- 101 TO PROTECT OPEN SPACE LANDS IN THE CITY OF CARLSBAD. WHEREAS, the City Council at its regular meetir December 19, 1989, by the adoption of Interim Ordinance No. NS determined it was necessary pending public hearings on recommendations of a citizen's committee on open space to i interim controls to insure that the public health, safet] welfare are protected by requiring new applications for develo to preserve the open space lands as identified on Exhibit I'd that ordinance entitled "Comprehensive Open Space Network dated August 1989 so that the City Council's considerations ar prejudiced: and WHEREAS, at its regular meeting of January 2, 1990 City Council approved the work plan for considering recommendations of the report from the citizen's committee to open space with the understanding that Task 1 involving the study will include consideration of maintenance and liabili the proposed trail system and that Task 2 involving g management standards will include the open space subcommitte the groups responsible for said task: and WHEREAS, the City Council at its regular meetil December 19, 1989 set a public hearing for January 23, 19' consider extending Interim Ordinance No. NS-101 to July 1, and I i .- 1 2 3 4 5 6 7 8 9 10 11 12 na $Z& $gag $&!: 14 Z>?2 0,gK mGog 15 ri 'a-1 $wwo >ma EKK~ 16 zags Bo $9~ 13 2' +y CY% 17 18 19. 20 21 22 23 24 25 26 27 28 0 0 WHEREAS, the interim ordinance may be extended for c ten months and fifteen days following a noticed public hea pursuant to Government Code Section 65858(a), NOW, THEREFORE, the City Council of the City of Carl does ordain as follows: SECTION I: That the provisions of Interim Ordinancc NS-101 are hereby extended to July 1, 1990. DECLARATION OF URGENCY: This ordinance is hc declared to be an emergency ordinance adopted as an urgency mei to protect the public health, safety and welfare and shall effect immediately upon its adoption. The facts constituting emergency are those set forth in Ordinance No. NS-101 and attachments and represent a threat to the public health, safe- general welfare of the citizens of Carlsbad. EFFECTIVE: This ordinance shall be effective immedi; upon passage and shall be of no further force and effect after 1, 1990 or completion of, Phase I of the ttwork plan" whicl occurs first unless, prior to that time, it is extended by a : fifths vote of the City Council pursuant to Government Code Set 65858(a).
