NS-111 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARL: CALIFORNIA ADOPTED AS AN URGENCY ORDINANCE EXTENDIN( TEMPORARY ORDINANCE PROHIBITING THE EXPANSION OF GA! ELECTRIC UTILITY FACILITIES LOCATED WITHIN THE PI UTILITY ZONE PENDING STUDIES AND CHANGES IN THE GEI PLAN AND ZONING ORDINANCE. WHEREAS, the City Council at a public hearing at regular meeting of Tuesday, January 23, 1990, determined it necessary to prohibit development applications which would inc: the size, location, generating compacity or use of the exi! Encina power generating facility within the general plan designation vtPUtt zoning disticts as shown on the map attachc Exhibit A to that ordinance pending Comprehensive Studies 0: General Plan, Local Coastal Plan, Specific Plan and ZI Ordinance; and WHEREAS, the City Council at said meeting of Januar 1990, set a public hearing for February 13, 1990, to con; extending Interim Ordinance No NS-108; and WHEREAS, the Interim Ordinance may be extended for 22 months and 15 days following notice and public hearing pri the expiration of 45 days from the adoption of Ordinance No. N pursuant to Government Code Section 65858(b). NOW, THEREFORE, the City Council of the City of Carl California does ordain as follows: SECTION 1 : That the provision of Interim Ordi No. NS-108 is hereby extended for 22 months and 15 days. SECTION 2 : At least 10 days prior to the expir of this ordinance, the City Council shall issue a written r describing the measures taken to alleviate the conditions lead to the adoption of this ordinance. ~ ~ I 1 4 I. e 0 DECLARATION OF URGENCY: This ordinance is he 1 2 declared to be an emergency ordinance adopted as an urgency me: to protect the public health, safety and welfare and shall 3 11 effect immediately upon its adoption. The facts constitutinc 4 11 emergency are set forth above and represent a threat to the pi 5i 11 health, safety or welfare of the citizens of Carlsbad. 6 EFFECTIVE: This ordinance shall be effective immedi; 7 to the adoption of this ordinance and cause it to be published lo City Council.
