NS- 1 5 4 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 3, MUNICIPAL CODE BY THE AMENDMENT OF SECTIONS 3.29.040 AND 3.30.020 TO REVISE THE PROCEDURES OF SURPLUS CITY PROPERTY AND LOST AND UNCLAIMED PROPERTY The City Council of the City of Carlsbad CHAPTERS 3 29 AND 3 30 OF THE CARLSBAD California, does ordain as follows: SECTION 1: That Title 3, Chapter 3.29 of th Carlsbad Municipal Code is amended by the amendment of Sectio 3.29.040 to read as follows: tt3.29.040 Manner of Disposal. (a) If the surplus property which is no. required for city use has an estimated market value of les; than twenty-f ive thousand dollars, the city manager ma: authorize the disposal of the property by: (1) public auction; (2) negotiated sale to other San Diegl county municipalities or governmental agencies at a prici determined to be fair and reasonable; (3) sealed bids. If the items of city-owned personal propert: are determined to be I'unable to be soldt1 by the city manage: after an attempt at sale through the above prescribe1 procedures, they may be donated to a charitable organizatio: in lieu of discarding such property. Charitable organization: shall mean non-profit organizations exempt fromtaxation unde: provisions of Internal Revenue Code, whose primary purpose i: public service. (b) If the surplus property which is no- required for city use has an estimated market value of morc than twenty-five thousand dollars, the city manager shal dispose of the property as provided by resolution of the Cit; Council. (c) The amount received for any property solc pursuant to this chapter shall be credited to the appropriatc fund as the city manager shall determine." (a) All lost and unclaimed property, includin bicycles, in the possession of the police department shall bc held by the department for a period of at least three months Lost and unclaimed animals shall be turned over to the Sal Diego County animal regulation department. Lost and unclaimec perishable property shall be held by the department for a. least twenty-four hours. (b) All lost and unclaimed property in th possession of the department shall be tagged showing the dat and circumstances of its acquisition by the department.'@ EFFECTIVE DATE: This ordinance shall be effectiv thirty days after its adoption, and the city clerk shal: certify to the adoption of this ordinance and cause it to bc published at least once in the Carlsbad Journal within fifteel days after its adoption. INTRODUCED AND FIRST READ at a regular meeting oj the Carlsbad City Council on the 25th day oi June , 1991, and thereafter PASSED AND ADOPTED at a regular meeting of the City Council of the City of Carlsbad on the 2nd day of July 1991, by the following vote, to wit: I AYES: Council Members Lewis, Kulchin, Larson, Stanton and 1 NOES: None ABSENT : None AmVED AS TO FORM AND LEGALITY CLAUDE A.
