ORDINANCE NO. NS-170
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIF
AMENDING TITLE 18, CHAPTER 18.1 6, BY THE ADDITION OF SECTION 18
TO THE CARLSBAD MUNICIPAL CODE TO AMEND BY REFERENCE THE U~
PLUMBING CODE, 1988 EDITION TO REQUIRE ULTRA LOW FLUSH TOILET.
The City Council of the City of Carlsbad, California, does ordain as follows:
SECTION 1 : The City Council finds that unique circumstances require certai
conservation amendments to the Uniform Plumbing Code. The amendments set fort
ordinance are reasonably necessary because of the local climate which includes low
and periods of drought. It has become necessary to import over ninety percent of tt-
for this area. These findings are consistent with the State of California ethic o
conservation and are made pursuant to Sections 17958.5, 17958.7 of the Californiz
and Safety Code.
SECTION 2: That Title 18, Chapter 18.16 is amended by the addition of
18.1 6.070 to read as follows:
18.1 6.070 Add Section 901.1 and 901.2, ChaDter 9. Uniform Plumbina Code,
as follows:
901.1 Ultra Low Flush Toilets. Effective fl/3 / 91 , only tank-typt
closets that use an average of 1.6 gallons of water per flush or less, and urin;
associated flushometer valves, that use an average of 1 gallon of water per flush or le
be installed in new construction. All tank-type water closets, urinals and ass
flushometer valves shall be approved by the Building Official as meeting adequate st:
of safety and sanitation. The provisions of this Section shall apply to existing buildin
when toilets are being replaced in existing bathrooms or installed in new bathrooms
ExceRtions: The Building Official may allow the use of standard flush toilets or
when, in the opinion of the Building Official, the configuration of the building drainage
requires a greater quantity of water to adequately flush the system.
The requirements for the maximum flush rate of 1.6 gallons per flush r
suspended for a specified period of time by a Resolution adopted by the City Council
finding by the Building Official that there is an inadequate supply of water closets or
specified in this Section to satisfy the needs of new construction. Further, wI
unreasonable hardship can be demonstrated by an applicant the Building Official ma
an exemption to the requirements of this Section.
