NS-177 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA AMENDING TITLE 18, CHAPTER 18.42 OF THE CARLSBAD MUNICIPAL CODE ESTABLISHING A TRAFFIC IMPACT FEE 4 5 6 WHEREAS, a report entitled "City of Carlsbad Circulation Implementa Program and Traffic Impact Fee Study" was completed in April 1991 and is incorporE 7 as Exhibit A to this ordinance (hereinafter referred to as the "Traffic Impact Fee Stul 8 and 9 WHEREAS, the Traffic Impact Fee Study estimates the capital cost 10 WHEREAS, fees to implement the construction of those improvements 11 construction of improvements to implement the City's Circulation Program; and I.2 11 set forth in the Traffic Impact Fee Study; and 13 11 WHEREAS, the fees so established do not exceed the reasonable c l4 11 of constructing these facilities and the fees are not levied for general revenue purpo 15 16 and 17 18 WHEREAS, this study was available for public inspection and re3 fourteen (1 4) days prior to this public hearing; and 19 I WHEREAS, the Finance Director is directed to establish a fund or fl necessary to collect the fees so imposed and to maintain said fund or funds an( 20 21 payments or other construction activities set forth in the Traffic Impact Fee Study. 22 interest collected therein and to authorize expenditures for only those projects, 1 23 Finance Director is further directed to make a report, at least annually, and within 24 (60) days of the close of the fiscal year determining the beginning and ending bala 25 for the fiscal year and the fees, interest and other income and amount of expenditul 26 27 each public facility. The Fin; Director shall monitor these funds so that, if required, the City Council may make WI findings that all or any portion of the fees remaining unexpended or uncommitted it fund for five (5) or more years are still necessary and needed for the purpose to n the fee is to be expended and demonstrate a reasonable relationship between tha and the costs of the improvements. NOW, THEREFORE, the City Council of the City of Carlsbad, Califc does ordain as follows: SECTION 1 : That Title 18 Chapter 18.42 of the Carlsbad Municipal ( is retitled "Traffic Impact Fee" and amended by the amendment of Section 18.42.0' read as follows: "Chapter 18.42 TRAFFIC IMPACT FEE 18.42.01 0 Purpose and intent. (a) This chapter imposes a fee to pay for various traffic circuli improvements within the City of Carlsbad. The amount of the fee is based on a tl engineering analysis and has been calculated to be equal to or less than the cost o circulation improvements. The circulation improvements funded by this fee sha designated by City Council resolution. The City Council may modify the designatio amendment to the resolution at any time. It is the City Council's intention to reviev designation of circulation improvements and the amount of the fee on an annual b In reviewing the improvements and amount of the fee the City Council shall consider, among other things, any changes to the land designations or intensity of development, changes in the amount of traffic generatc anticipated, inflation, and increases in cost of materials and labor. (b) This chapter is necessary to ensure that adequate circulation facilitie! available to serve the City of Carlsbad in a manner which is consistent with the C general plan. Without the circulation improvements which will be funded by this fec circulation system of the City will be inadequate to serve any further development it City. SECTION 11: That Title 18, Chapter 18.42 of the Carlsbad Municipal Coc amended by the amendment of Section 18.42.020(d) to read as follows: 18.42.020 Definitions. City of Carlsbad. (a) A traffic impact fee of seventy-seven dollars for each average dail) generated by a residential project, a traffic impact fee of thirty-one dollars for c average daily trip generated by a commercial or industrial project, pursuant to Sec 18.42.020(e), shall be paid by the owner or developer prior to the issuance of building permit or occupancy permit for a project. Traffic Impact Fees shall be adju annually as part of the City's Capital Improvement Program budget process, effective 1,1991, according to the Engineering News Record Los Angeles Construction Cost 11 with a base year index of 5930. 14 amended by the amendment of Section 18.42.070 to read as follows: 15 SECTION V: That Title 18, Chapter 18.42 of the Carlsbad Municipal Coc 16 17 18.42.070 Use of Fee. All of the fees collected shall be allocated to a circuli improvement account and shall be expended only to build or finance circuli improvements serving the City.'' 18 19 EFFECTIVE DATE: This ordinance was adopted at a noticed p I hearing at which time the Council also considered the Traffic Impact Fee Study VI 20 21 22 23 24 25 study and associated information was available to the general public for a period least fourteen (1 4) days prior to the public hearing. The fee established by this ordin shall apply to the issuance of any building permit, for any residential development ism sixty (60) days following this ordinance's adoption and for all other types of develop1 thirty (30) days following its adoption.
