ORDINANCE NO. NS-193
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, AMENDING TITLE 5,
CHAPTER 5.12 OF THE CARLSBAD'MUNICIPAL CODE BY THE ADDITION OF SECTION 5.12.025 TO ESTABLISH REGULATIONS OF CARD GAMES IN PUBLIC BUILDINGS
WHEREAS, seniors at the Carlsbad Senior Center desir
to play cards where nominal consideration is paid fc
confectioneries, an annual dinner and monetary prizes; and
WHEREAS, the seniors do not wish to violate th
provisions of Carlsbad Municipal Code Chapter 5.12 entitle
vlCardroomsll ; and
WHEREAS, complaints have been received that th
playing of cards at the Carlsbad Senior Center constitute
gambling; and
WHEREAS, the office of the district attorney ha
determined that such card games do not violate any state law
and
WHEREAS, it is necessary to amend Chapter 5.12 of th
Carlsbad Municipal Code entitled llCardroomsvv to provide a
exception for the playing of cards at the Carlsbad Senic
Center: and
WHEREAS, this exception will not permit the playing c
cards or cardrooms at any other place or location in the City c
Carlsbad except where previously lawfully existing cardrooms a
provided in that chapter,
NOW, THEREFORE, the City Council of the City c
Carlsbad, California, does ordain as follows:

SECTION 1: That Title 5, Chapter 5.12 of the Carlsba
Municipal Code is amended by the addition of Section 5.12.025 t
read as follows:
"5.12.025 Exceptions
'IThis chapter shall not apply to the lawful playing a
card games at the Carlsbad Senior Center at such time and under such reasonable rules and regulations a established by the city manager.It
EFFECTIVE DATE: This ordinance shall be effectiv
thirty days after its adoption, and the city clerk shall certif
to the adoption of this ordinance and cause it to be publishe
at least once in the Carlsbad Journal within fifteen days afte
its adoption.
INTRODUCED AND FIRST READ at a regular meeting of th
Carlsbad City Council on the 18th day of February , 1992
and thereafter
PASSED AND ADOPTED at a regular meeting of the Cit
Council of the City of Carlsbad on the 3rd day of March
1992, by the following vote, to wit:
AYES: Council Members Lewis, Kulchin, Larson, Stanton, and I
NOES: None
ABSENT: None
