ORDINANCE NO. NS-223
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIAl AMENDING TITLE 2,
CHAPTER 2.04 OF THE CARLSBAD MUNICIPAL
CODE BY THE AMENDMENT OF SECTION 2.04.030 TO
ALLOW SPECIAL ELECTIONS TO BE HELD MORE THAN
270 DAYS FROM THE CALL OF THE ELECTION
The City Council of the City of Carlsbad, California
does ordain as follows:
SECTION 1: That Title 2, Chapter 2.04 of the Carlsba
Municipal Code is amended by the amendment of section 2.04.03
to read as follows:
112 .04.030 Vacancies - Special election to fill afte
a term of temporary appointee. This section is adopted pursuan
to the authority of California Government Code sectio
36512(c)(3). A person appointed to fill a vacancy on the Cit
Council shall hold off ice only until the date of a specia
election which shall immediately be called to fill the remainde
of the term. Such special election may be held on the date o
the next regularly established election or the next regular1
scheduled election to be held throughout the city but not les
than 90 days from the call of the special election.''
EFFECTIVE DATE: This ordinance shall be effectiv
thirty days after its adoption, and the city clerk shall certif
to the adoption of this ordinance and cause it to be publishe
at least once in the Carlsbad Journal within fifteen days afte
its adoption.

Carlsbad City Council on the 26th day of JANUARY I 1993
and thereafter
