NS-235 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 2 OF THE CARLSBAD MUNICIPAL CODE BY REPEALING CHAPTER 2.40 AND ADDING A NEW CHAPTER 2.40 TO ESTABLISH A HOUSING COMMISSION WHEREAS the City declared on November 6, 1979 in Ordinance No. 1223 a need for both a Housing Authority and Redevelopment Agency pursuant to Health and Safety Code Section 34110; and WHEREAS the City declared the need for the joint operation of the Housing Authority and Redevelopment Agency as a Community Development Commission; and WHEREAS at that time the City Council declared itself to be the commissioners of the joint commission; and WHEREAS the City of Carlsbad reaffirms the need for a Housing Authority without effecting the previous declaration; and RHEREAS the City of Carlsbad declares that a Housing Commission formed pursuant to Health and Safety Code Section 34291 is necessary for the implementation and formation of various housing programs, NOW THEREFORE, the City Council of the City of Carlsbad, does ordain as follows: SECTION 1: Chapter 2.40 of Title 2 of the Carlsbad Municipal Code is repealed and a new Chapter 2.40 is added to read as follows: I I1 1 2 3 4 5 6 0 0 "Chapter 2.40" HOUSING COMMISSION Sections: 2.40.010 Established. 2.40.020 Membership. 2.40.030 Qualifications. 2.40.040 Meetings. 2.40.050 Vote required. 2.40.060 Functions. , 7 2.40.010 Established. Pursuant to Section 34291 of the 8 created as an advisory body to the City Council and Housing 9 California Health and Safety Code, a Housing Commission is 10 and Redevelopment Commission. 11 2.40.020 Membership. The Housing Commission shall 12 by the Mayor and confirmed by the City Council. After the 13 consist of seven (7) members. The members shall be appointed terms as follows: 19 initial members of the Commission shall serve staggered 18 their successor is duly appointed and qualified. All members of the Housing Commission shall reside, work or own a business or property within the City limits of Carlsbad. In addition, two (2) members of the Housing Commission shall be tenants assisted by the Carlsbad Housing Authority, one (1) of which shall be at least 62 years of age. One (1) member shall be a member of the Planning Commission. The remaining four (4) members shall, to the extent possible, have experience and expertise within one or more of the following areas: development, construction, real estate, social services, housing advocacy, planning, architecture and/or finance. To the extent possible, the Commission members shall be representative of the four quadrants of the City. If a tenant member ceases to be a tenant assisted by the Authority and a non-tenant member ceases to reside, work or ~ own a business or property within the city limits of the City of Carlsbad, his/her membership on the Commission shall terminate and another member shall be appointed for the remainder of the unexpired term. 2.40.040 Meetinss. The Housing commission shall meet regularly, on days and times established by the Commission for the transaction of business. The Commission may adjourn any regular meeting to a time and place specified at the regular meeting and any such adjourned meeting shall be l deemed a regular meeting. The Housing Commission shall I 0 0 I/ elect from among its appointed members a chairman and vice- 1 // chairman. The rules and procedures of the Planning 2 3 4 5 6 7 8 9 10 11 12 13 14 Commission shall be modified, as necessary, and approved by the Housing Commission for the conduct of its business. 2.40.050. Vote required. Four members of the Housing Commission shall constitute a quorum. The affirmative vote ~ of four members shall be necessary for any action by the Commission. 2.40.060 Functions. The Housing Commission shall advise and make recommendations to the Housing and Redevelopment Commission and/or the City Council as either body may request, including but not limited to the following: 0 establishment or amendment of affordable housing programs, policies and regulations; 15 16 17 e establishment or implementation of affordable housing agreements; and 0 review of affordable housing projects including project 18 19 20 21 22 23 24 concept; affordability objectives; and, requests for City participation or incentives; and e the Commission shall annually report to the City Council on the status and progress of affordable housing programs. Where appropriate, and particularly with respect to affordable housing projects, the Housing Commission shall 25 26 27 provide its advice to and coordinate its reviews with the Planning Commission. For purposes of the Housing 28 L * 1 2 3 4 5 6 71 e Commission, an affordable housing project shall be defined as a project that provides housing to households of lower income or below as defined by the Housing Element of the General Plan, and proposes use of City-provided development incentives. EFFECTIVE DATE: The ordinance shall be effective I ~ thirty days after its adoption, and the City Clerk shall 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 certify to the adoption of this ordinance and cause it to be published at least once in the Carlsbad Journal within fifteen days after its adoption. INTRODUCED AND FIRST READ at a regular meeting of the City Council of the City of Carlsbad, California, held on the 6th day of APRIL , 1993, and thereafter.
