NS-303 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CmLSBAD8 CALIFORNIA8 AMENDING TITLE 188 CHAPTER 18.07 8 ENTITLED "UNREINFORCED MASONRY BUILDINGS" WHEREAS, the State of California has enacted Chapter 12 Division 1 of Title 2 of the California Government Code ent "Building Earthquake Safetyt1 (GCS8875 et. seq.), and WHEREAS, the State Seismic Safety Commission has establ certain criteria, guidelines, and requirements regardin5 mitigation of unreinforced masonry structures in accordance this law, and WHEREAS, the City of Carlsbad desires and intends to ado1 comply with said criteria, guidelines, and requirement accordance with this law and the State Seismic Safety Commis: NOW, THEREFORE, the City Council of the City of Carlsbac hereby ordain as follows: SECTION 1: That Title 18, Chapter 18.07, Section 18.07.( the Carlsbad Municipal Code is amended to read as follows: 18.07.030 Actions by the Buildins Official. Whenever determined by the building official of the city or his o designee that a building falls within the criteria for a potenl hazardous structure, as defined by this chapter, and the strl is not exempted for local conditions as defined by California I and Safety Code Section 18491.6(b), the building official and : her designee shall take steps to ensure that the provisions ( code relating to mitigation are carried out as follows: (1) Service of Order. SECTION 2: That Title 18, Chapter 18.07, Section 18.07.( added to the Carlsbad Municipal Code to read as follows: 18.07.040 Definitions. "Potentially hazardous building" any building constructed prior to the adoption of local bu: codes requiring earthquake resistant design of building: constructed of unreinforced masonry wall construction. IrPotenl hazardous building" includes all buildings of this type, inch but not limited to, public and private schools, theaters, plac public assembly, apartmentbuildings, hotels, motels, fire stal police stations, and buildings housing emergency sen equipment , or supplies, such as government buildings, diz relief centers, communications facilities, hospitals, blood 1 pharmaceutical supply warehouses, plants, and retail oul "Potentially hazardous building" does not include warehous similar structures not used for human habitation, excep' warehouses or structures housing emergency services equipme supplies. IIPotentially hazardous building" does not incluc building having five living units or less. ltPotentially haz; building" does not include, for purposes of subdivision ( Section 8877 of the California Government Code any building qualifies as "historical property" as determined by an appro1 governmental agency under Section 37602 of the Health and : Code. EFFECTIVE DATE: This ordinance shall be effective thirt! after its adoption, and the City Clerk shall certify to the adc of this ordinance and cause it to be published at least oncc newspaper of general circulation in the City of Carlsbad 1 fifteen days after its adoption.
