AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD
CALIFORNIA,, AMENDING TITLE 18 BY THE AMENDMENT OF CHAPTEF
18.04, TO ADOPT BY REFERENCE THE UNIFORM BUILDING CODE (199'
EDITION) AND THE UNIFORM BUILDING CODE STANDARDS (199L
EDITION).
The City Council of the City of Carlsbad, California, does ordain as follows:
SECTION 1: Whereas, the City of Carlsbad is supplied with water and sewer ir
areas by other entities. It has been necessary in the past to allocate sewer use. (!
106.4.1 and 106.4.4) Other amendments are in reference to fire protection. The
Carlsbad has many large brush-covered hillsides. The City is subject to a frequent S:
condition of dry, gusty winds, which creates extreme fire danger. The City
specifically finds that these geographic and topographic conditions require gre
protection than that: provided by the Uniform Building Code, 1994 Edition. TI
Chapter 18.04 has altered the Uniform Building Code to require prepaid sewer ar
fees, and to require all fire retardant roofs and more sprinklered buildings.
SECTION 2: That Title 18, chapter 18.04 of the Carlsbad Municipal Code is I

Every permit issuled by the Building Official under the provisions of this code shal by limitation and bec:ome null and void if the building or work authorized b such p not commenced within one calendar year from the date of such permit, or i Y the buil work authorized by such permit is stopped at any time after the work is commence

Accordingly, plans shall reflect the requirements of the current codes in effect. A
plan check is required, and a full new plan check fee shall be paid. Upon comple new plan check, the permit may be renewed upon payment of a permit fee equal to the amount required for a new permit. The renewal permit shall expire three calenc from the date of initial permit issuance.
2. PERMITS WHERE WORK HAS COMMENCED. For permits where v commenced and was subsequently stopped as defined herein, a renewal permit obtained provided:
(A) No (changes have been made or will be made in the original p~ specifications for such work.

except that where construction has progressed and has been approved to the

3. PERMITS THAT HAVE EXCEEDED THREE YEARS. For permits that have ex three years beyond the issuance date, a renewed permit may be obtained provided:
(A) Constriuction in reliance upon the building permits has commenced an
approved. (B) No changes have been made or will be made in the original pla
specifications for such work. (C) A fee equal to the full amount required for a new permit be paid, excc
where the Building Official determines that construction has progressed to the PC

The maximum lkfe of a permit renewal in accordance with this subsection shall
calendar year from the date of renewal. The permit may be renewed for each calenc thereafter provided that all requirements of (A), (B), and (C) as stated in this subsec

4. EXTENSION OF AN UNEXPIRED PERMIT. Any permittee holding an un
permit may apply for an extension of the time within which he may commence wor

18.04.160 Section 403.1 amended - Soecial Provisions. Section 403.1 of the L Building Code is amended to read:
Scope. This section applies to all 'Group B office buildings and Group R, Div
Occupancies, each having floors used for human occupancy located more than 55 fee the lowest level of fire department vehicle access. Such buildings shall be of Type I o construction and shall be provided with an approved automatic sprinkler sys

18.04.230 Section 1501 amended - Scope. Section 1501 of the Uniform Buildin shall be amended to read;
Roof and roof structures shall be as specified in this Code and as otherwise requ this Chapter.
Roof coverings shall be fire retardant, Class B or Class A.
Roof coverings shall be secured or fastened to the supporting roof construction ar
provide weather protection for the building at the roof.
Subject to the requirements of this Chapter, combustible roof coverings ai
insulation may be used in any type of construction.

18.04.235 Section 31 02.3.8 amended - %ark Arrester. Section 31 02.3.8 of the I Building Code is amended to read:
All chimneys attached to any appliance or fireplace that burns solid fuel 5 equipped with an approved spark arrester. The net free area of the spark arrester shal less than four times the net free area of the outlet of the chimney. The spark arreste
shall have heat and corrosion resistance equivalent to 12 gauge wire, 19 gauge gal
wire or 24 gauge sta.inless steel. Openings shall not permit the passage of spheres 1
diameter larger than lh-inch and shall not block the passage of spheres having a (
of less than 3/8-inch.
18.04.260 Section 904.2 amended -Automatic Fire Extinguishing Systems. Sectic
of the Uniform Building Code is amended to add:
904.2.1.1. Excluding detached R-3 occupancies, in buildings two or more s height, an automatic fire-extinguishing system shall be installed in those areas n below the lowest elevation of Fire Department vehicular access. The access elevati be determined by the Fire Chief.
904.2.1.2. Other provisions of this section notwithstanding, all buildings I constructed in which the aggregate floor area exceeds 10,000 square feet shall be p by an approved automatic fire-extinguishing system.

An automatic sprinkler system conforming to UBC Standard 9-1 shall be it
throughout every apartment house three or more stories in height or containing 16 c dwelling units, every congregate residence three or more stories in height or ha\ occupant load of 20 or more, and every hotel three or more stories in height or cor 20 or more guest rooms.
Apartment housles and other residential buildings, having an aggregate floc
exceeding 10,000 square feet, may be protected by an approved automatic fire SI
system conforming tlo UBC Standard 9-3 when they are one or two stories in hei
contain fewer than 16 dwelling units. Such automatic sprinkler systems shall
considered as the basis for increasing the allowable area of a building or for exempti
