NS-334 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALlFORNIA,AMENDINGTITLE 18,CHAPTER18.16, BYTHEAMENDMENT OF SECTIONS 18.16.010, 18.16.070, 18.16.120, 18.16.130 AND 18.16.160 OF THE CARLSBAD MUNICIPAL CODE TO ADOPT BY REFERENCE THE UNIFORM PLUMBING CODE (1994 EDITION). The City Council of the City of Carlsbad, California, does ordain as follows: SECTION 1 : That Title 18, Chapter 18.16 of the Carlsbad Municipal Code is ar by the amendment of Sections 18.16.010, 18.16.070, 18.16.120 and 18.16.130 to follows: 18.16.010 AdoDted. The 1994 Edition of the Uniform Plumbing Code, copy by the International Association of Plumbing and Mechanical Officials, is ado1 reference as the plumbing code of the City, except for the changes, additio amendments set forth in this chapter, which shall supersede the provisions of said I 18.1 6.070 Section 402.3 added - Ultra Low Flush Toilets. Section 402.3 is a( the Uniform Plumbing Code to read: Effective November 3, 1991, only tank-type water closets that use an averag gallons of water per flush or less and urinals and associated flushometer valves tha average of one gallon of water per flush or less shall be installed in new constructi tank-type water closets, urinals and associated flushometer valves shall be approve( Building Official as meeting adequate standards of safety and sanitation. The prov this Section shall apply to existing buildings only when toilets are being replaced in bathrooms or installed in new bathrooms. Exceptions: The Building Official may allow the use of standard flush toilets c when, in the opinion of the Building Official, the configuration of the building 1 system requires a greater quantity of water to adequately flush the system. The requirements for the maximum flush rate of 1.6 gallons per flush suspended for a specified period of time by a resolution adopted by the City Coun a finding by the Building Official that there is an inadequate supply of water closets c specified in this Section to satisfy the needs of new construction. Further, \ unreasonable hardship can be demonstrated by an applicant the Building Official rr an exemption to the requirements of this Section. Section 102.3.1 of the 1 Plumbing Code is amended to read: Any person or corporation who violates any of the provisions of this chapter of an infraction except for the fourth or each additional violation of a provision wii year which shall be a misdemeanor. Penalties for a violation of this chapter sh; designated in Section 1.08.010 of this code. 18.1 6.1 30 Section 103.4.1 amended - Permit Fees. Section 103.4.1 of the Plumbing Code is amended to read: (a) Permit Fees. Every applicant for a permit to do work regulated by this code shall state in w the application form provided for that purpose the character of work proposed to bed such information pertinent thereto as may be required. Such applicant shall pay permit issued at the time of issuance a fee in accordance with the following schedul the rate provided for each classification shown herein. Any person who commences any work for which a permit is required by tl without first having obtained a permit therefor shall, if subsequently permitted to permit, pay double the permit fee fixed by this section for such work. This provisl not apply to emergency work when it is proved to .the satisfaction of the Admir Authority that such work was urgently necessary and that it was not practical to permit therefor before the commencement of the work. In all such cases a permit obtained as soon as it is practical to do so, and if there is an unreasonable delay in c such permit, a double fee shall be charged.
