AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, AMENDING
TITLE 21 OF THE CARLSBAD MUNICIPAL CODE BY
AN AMENDMENT TO THE ZONING MAP TO GRANT
PROPERTY GENERALLY LOCATED AT THE
NORTHWEST CORNER OF FUTURE POINSETTIA
LANE & BLACKRAIL COURT, IN LOCAL FACILITIES
MANAGEMENT ZONE 20.

The City Council of the City of Carlsbad, California does ordain as fol
SECTION I: That Title 21 of the Carlsbad Municipal Code is amend
the amendment of the zoning map as shown on the map attached hereto and made i

SECTION 11: That the findings and conditions of the Planning Comm
as set forth in Planning Commission Resolution No. 3868 constitutes the finding
conditions of the City Council.
SECTION 111: The Council further finds that this action is consisten
the General Plan and the Housing Element of the General Plan in that it is cons
with residential land use and affordable housing goals and objectives.
SECTION IV. Prior to approval of final mag or issuance of gl
permits, whichever occurs first, the applicant shall provide evidence of consultatio
written consent, if required, from SDG&E for grading or other improvements 7
SDG&E transmission easements impacted by the project. Failure by SDG&E to ap]
conditionally approve, or deny the applicant’s documented request within 60 days
fling of the applicant’s request with SDG&E shall satisfy this requirement.
EFFECTIVE DATE This ordinance shall be effective thirty days ai 1 adoption, and the City Clerk shall certify to the adoption of this ordinance and CE
