AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA AMENDING THE GWEN
VALLEY MASTER PLAN BY THE AMENDMENT OF
VARIOUS SECTIONS WHICH ADD SUGGESTED
MODIFICATIONS MADE BY THE CALIFORNIA COASTAL,
COMMISSION

WHEREAS, Carlsbad Partners, LTD. filed a verified application whit

WHEREAS, pursuant to the provisions of the Municipal Code, the City C

approved the Master Plan and Local Coastal Program Amendment; and
WHEREAS, The California Coastal Commission considered the Master P
May 7* 1996 as an amendment to the Local Coastal Program to adopt the Master Plan
implementing Ordinance for the Green Valley area off the East Batiquitos Lagoo]
Properties segment of the Carlsbad Local Coastal Program and approved the Master Pla
suggested modifications; and
WHEREAS, the verified application has been referred back to the PI2
Commission as an amendment as shown herein for acceptance of the suggested modific
made by the California Coastal Commission; and
WHEREAS, pursuant to the provisions of the Municipal Code, the Pla
Commission did, on the 3rd day of July 1996, consider said request for a Master

A portion of Section 2, Township 13 South, Range 4 West: and a
portion of Section 35, Township 12 South , Range 4 West, San
Bernardino Meridian, City of Carlsbad, County of San Diego, State
of California.
WHEREAS, at said public hearing, upon hearing and considering all te!
and arguments, if any, of all persons desiring to be heard, said Commission considered all
relating to MP 92-0 1 (A) and recommended approval thereof.
NOW, THEREFORE, the City Council of the City of Carlsbad, Califon
ordain as follows:
SECTION I: That the Green Valley Master Plan, being Ordinance No. y
shall be amended as follows:
A. Section A(5), under General Communitv Development Guidelines, on pagt
of the Master Plan is amended to read as follows:
(5.) Temporary runoff control devices shall be installed immediately after gradi
operations have started, but must be in place prior to the beginning of the r;
season (October lst), monitored and maintained throughout the rainy seaso
B. Section A(9), under General Communitv Development Guidelines, on pagt
of the Master Plan is amended to read as follows:
(9.) Required hydroseeding, landscaping, and irrigation shall be installed after 1
and be completed prior to Octoberlst of any year.
C. General Comrnunitv Development Guidelines, on page IV-2 of the Master
is amended by the addition of Section A( 13) to read as follows:
(1 3 .) Conversion of all non-prime agricultural lands to urban uses shall require tl
payment of an agricultural mitigation fee pursuant to Section 30171.5 of th
Coastal Act.
I D. Section D( l), under Open Space and Biological Habitat Enhancement Plan
page V-5 of the Master Plan is amended to read as follows:
(1) The expansion of the riparian woodland includes approximately 20 acres 0:
native riparian woodland. Some of this acreage is mitigation for the disturl
of pre-existing habitat that is caused by the two road crossings. Mitigation
riparian impacts shall be at a 3: 1 ratio and mitigation for wetland impacts I

at a 4: 1 ratio by the creation of new habitat from existing upland area onsitt
E. Under Section E, titled Biological Mitigation Program, the second paragrar
page V-8 of the Master Plan is amended to read as follows:
The primary goal of the mitigation program for the riparian woodland, wetlands an
upland habitats of Green Valley is to create new habitat areas to offset areas lost dl
construction of the proposed project so that the net loss in both quantity and qualit:
various habitats does not occur. Additionally, it will protect the pre-existing habiti
from the impacts associated with construction of the proposed project. The specifi
details of the- mitigation and monitoring will be developed at the time of developn
permit review.
F. The Master Plan is further amended by the deletion of those portions of pal
through V- 12 in Section E Biological Mitigation Program beginning with (
of the Mitigation Program.
G. Pertaining to Planning Area 1 , DeveloDment Standards, under Section VI(€
page VI-7 of the Master Plan is amended to read as follows:
Use Allocation
No urban development of construction improvements, including grading, is permil
this planning area except as noted below.
Permitted Uses
Open space compatible urban support uses are permitted as follows:

Pedestrianhicycle Trail
A portion of the Citywide trail system shall be located along the riparian buffer cc
either adjacent to and partially within the street right-of-way of Street "A", or wit1
buffer area adjacent to the riparian woodland. The portion of the Citywide trail sq
located in this planning'area shall be permanently reserved for use by the public tl
an offer to dedicate a trail easement to the City of Carlsbad at the time of approva
subdivision of the site. In addition, all pedestrian trail improvements shall be con
concurrent with site development and open and available for use by the public pri
occupancy of any structures.
Trailhead Parking
The Citywide trail System Plan shows a secondary staging area on the Green Val1
property. This staging area is proposed to be located near the intersection of Strec
and Calle Barcelona and will consist of a small parking area of six (6) spaces and
connection to the pedestrianhicycle trail. The trailhead parking shall be construc c

concurrent with site development and open and available for use by the public pric

H. Pertaining to Planning Area 2, Development Standards, under Section VI(C
page VI- 15 of the Master Plan is amended to read as follows:
Building Height
1. Buildings shall be limited to a maximum height of 35 feet including any rot
mounted equipment and screening elements.
2, Non-habitable architectural design features nnay extend to a maximum heigl
45 feet, but may not exceed three (3%) of the total roof area.
EFFECTIVE DATE: This ordinance shall be effective thirty days a
adoption, and the City Clerk shall certify to the adoption of this ordinance and cause i
published at least once in a newspaper of general circulation in the City of Carlsbad
fifteen days after its adoption. Notwithstanding the preceding, this ordinance shall
effective until approved by the California Coastal Commission.
