M-474 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ADOPTING THE AVIARA MASTER PLAN AMENDMENT RELATIVE TO THE CRISTALLA AVIARA PA 23 PROPOSAL ON PROPERTY GENERALLY LOCATED NORTH OF AVIARA PARKWAY, EAST AND WEST OF BLACK RAIL ROAD IN THE SOUTHWEST QUADRANT. CASE NAME: CRISTALLA - AVIARA PA 23 CASE NO.: MP 177(X) WHEREAS, the City Council of the City of Carlsbad, California has reviewed and considered a Master Plan Amendment for future development of the site; and 8 9 WHEREAS, the Aviara Master Plan was adopted by City Council Ordinance No. 10 9839 on December 22, 1987, and constitutes the zoning for the subject property; and 11 WHEREAS, the Aviara Master Plan has been amended a total of twenty-three 12 13 times since original adoption, most recently for MP 177(W) through City Council Ordinance No. NS-470 on March 2, 1999; and 14 WHEREAS, after procedures in accordance with requirements of the law, the 15 City Council has determined that the public interest indicates that said plan amendment be 16 17 18 approved. NOW, THEREFORE, the City Council of the City of Carlsbad, California, does ordain as follows: 19 SECTION I: That the Aviara Master Plan MP 177 as amended to date is 20 further amended by the Master Plan Amendment relative to Cristalla Aviara Planning Area 23, 21 MP 177(X), Exhibit “Z”, dated March 17, 1999, attached hereto and incorporated by reference 22 herein, is approved. The Master Plan Amendment shall constitute the zoning for this property 23 and all development of the property shall conform to the plan. 24 SECTION II: That the findings and conditions of the Planning Commission as 25 set forth in Planning Commission Resolutions No. 4470 shall also constitute the findings and 26 conditions of the City Council. 27 EFFECTIVE DATE: This ordinance shall be effective thirty days after its 28 II adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be .* I 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 8 e published at least once in a publication of general circulation in the City of Carlsbad within fifteen days after its adoption. (Not withstanding the preceding, this ordinance shall not be effective within the City’s Coastal Zone until approved by the California Coastal Commission.) INTRODUCED AND FIRST READ at a regular meeting of the Carlsbad City Council on the 20 th day of April 1999, and thereafter.
