ORDINANCE NO. m-574
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
~ OF CARLSBAD, CALIFORNIA, ADDING SECTION 2.40.080,
TO THE CARLSBAD MUNICIPAL CODE ESTABLISHING A RELOCATION APPEALS BOARD
WHEREAS, by concurrent action on February 13th, , 2001, the
City Council in its capacity as the Housing and Redevelopment Commission for the
Redevelopment Agency, the Board of Directors of the Carlsbad Municipal Water District,
and the City Council of the City of Carlsbad, California adopted Rules and Regulations for
Implementation of the California Relocation Assistance Law applicable to each of these
three separate legal entities; and
WHEREAS, the rules and regulations for all three entities make provision for
a Relocation Appeals Board, and
WHEREAS, Health and Safety Code section 33417.5 establishes, by
operation of law, a five-member Relocation Appeals Board appointed by the Mayor, subject
to the approval of the City Council; and
WHEREAS, Government Code section 7266 authorizes the City Council by
ordinance to designate the Redevelopment Agency Relocation Appeals Board as the
Relocation Appeals Board to hear appeals from all public entities, except State entities,
relating to relocation and compliance with local, state and federal relocation assistance
laws and regulations.

NOW, THEREFORE, the City Council of the City of Carlsbad ordains as
SECTION 1: That Section 2.40.080 is added to Chapter 2.40 of the
Carlsbad Municipal Code to read as follows:
“2.40.080 Relocation Appeals Board.
Pursuant to Government Code section 7266, the Housing Commission is designated as the Relocation Appeals Board for the City, the Carlsbad
Municipal Water District, and the Redevelopment Agency of the City of
Carlsbad to hear and determine (subject to appeal to the appropriate governing body) complaints regarding relocation and compliance with

applicable local, state and federal relocation assistance laws and regulations.”
2 EFFECTIVE DATE: This ordinance shall be effective thirty days after its
3 adoption; and the City Clerk shall certify the adoption of this ordinance and cause it to be
4 published at least once in a newspaper of general circulation in the City of Carlsbad within
5 fifteen days after its adoption.
6 INTRODUCED AND FIRST READ at a regular meeting of the Carlsbad City
7 Council on the 13th dayof February 2001, and thereafter
8 PASSED AND ADOPTED at a regular meeting of the City Council of the City
9 of Carlsbad on the 20th day of February 9 2001, by the following
10 vote, to wit:
