ORDINANCE NO. NS-682
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA AMENDING CHAPTERS 13.10 AND
14.16 OF THE CARLSBAD MUNICIPAL CODE TO UPDATE AND
REVISE THE WAY IN WHICH SEWER CAPACITY AND WATER
CONNECTION FEES ARE ADJUSTED.

The City Council of the City of Carlsbad, California, does ordain as follows:
SECTION 1: That Title 13, Chapter 13.10 of the Carlsbad Municipal Code is
3mended by the amendment of Section 13.1 0.030 to read as follows:
"13.1 0.030 Sewer capacity fee - Encina Treatment Plant.
Except as provided, every person who wishes to use the city sewer system and the
EncinaTreatment Plant shall pay to the city prior to the issuance of a sewer permit, a sewer
2apacity fee per equivalent dwelling unit. The amount of the Sewer Capacity fee shall be as set
'rom time to time by a resolution of the City Council.
The Sewer Capacity fee shall be adjusted annually by a resolution of the City Council by :he percentage change in the Engineering News Record Los Angeles Construction Cost Index
Nith the base index in effect in December 2003.
All Sewer Capacity fees shall be placed in the sewer construction fund and shall be used to

SECTION 2: That Title 14, Chapter 14.16 of the Carlsbad Municipal Code is
3mended by the amendment of Section 14.16.120 to read as follows:
"1 4.1 6.1 20 Service connection charges.
Applicants for installation of service connections shall pay connection charges as set from
ime to time by a resolution of the City Council.
The Water Connection fee shall be adjusted annually by a resolution of the City Council by
he percentage change in the Engineering News Record Los Angeles Construction Cost Index
with the base index in effect in December 2003. There will be no credit for the exchange of old
services for new services nor relocation of a service."
EFFECTIVE DATE: This ordinance shall be effective sixty (60) days after its adoption and
he City Clerk, City of Carlsbad, shall certify to the adoption of this ordinance and cause it to be
iublished at least once in a newspaper of general circulation in the City of Carlsbad within fifteen
15) days after its adoption.

INTRODUCED AND FIRST READ at a regular meeting of said City Council held on the
18th dayof November ,2003, and thereafter,
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
held on the 2nd day of December , 2003 by the following vote, to wit:
AYES: Council Members Lewis, Finnila, Kulchin, Hall and Packard
